EUROPEAN COMMUNITIES (MILK LEVY) (AMENDMENT) REGULATIONS, 1989.

I, MICHAEL O'KENNEDY, Minister for Agriculture and Food, in exercise of the powers conferred on me by Section 3 of the European Communities Act, 1972 (No. 27 of 1972) and for the purpose of giving effect to Council Regulation (EEC) No. 857/84 of the 31st day of March, 1984(1), and Commission Regulation (EEC) No. 1546/88 of the 3rd day of June, 1988(2), hereby make the following Regulations:

(1) OJ No. L90 of 1.4.1984, P.13

1. (i) These Regulations may be cited as the European Communities (Milk Levy (Amendment) Regulations, 1989.

(ii) These Regulations shall come into operation on the 13th day of March, 1989.

2. A word or expression which is used in these Regulations and is also used in Council Regulation (EEC) No. 857/84 of the 31st day of March, 1984(1) or in Commission Regulation (EEC) No. 1546/88 of the 3rd day of June, 1988(2), shall, unless the contrary intention is expressed, have in these Regulations the meaning that it has in those Regulations.

3. The European Communities (Milk Levy) Regulations, 1985 ( S.I. No. 416 of 1985 ), are hereby amended by the insertion of the following paragraph (2A) in Regulation 4 immediately following on paragraph (2) thereof, which new inserted paragraph shall read as follows:

"(2A) If at any time, the Minister in accordance with Paragraph (2) of this Regulation varies the percentage applied to determine a reference quantity, notice of such variation shall be given by ordinary prepaid post to each purchaser concerned and a notice indicating the terms thereof shall be inserted in a National newspaper. These notices should state in general terms the reasons for the variation effected by the Minister".

EXPLANATORY NOTE.

The Order relates to the re-allocation of milk quotas to certain special category producers from a national reserve set up by the Minister.
