MAINTENANCE ALLOWANCES (INCREASED PAYMENT) REGULATIONS, 1988.

The Minister for Health in exercise of the powers conferred on him by section 5 and sub-section (5) of section 44 of the Health Act, 1947 , (No. 28 of 1947), and by sections 69 and 72 of the Health Act, 1970 (No. of 1970 ), hereby makes the following Regulations:

1. These Regulations may be cited as the Maintenance Allowances (Increased Payment) Regulations 1988.

2. Where a person is or becomes entitled to—

( a ) payment under sub-section (3) of section 44 of the Health Act, 1947 in accordance with the Infectious Diseases (Maintenance) Regulations, 1988 ( S.I. No. 151 of 1988 ); or

( b ) payment of a maintenance allowance under section 69 of the Health Act 1970 in accordance with the Disabled Persons (Maintenance Allowances) Regulations, 1984 and 1988;

any amount so payable in respect of the week ending on the 2nd day of December, 1988 to or in respect of himself or his dependents shall be increased by a sum equal to sixty-five per cent of that amount.

EXPLANATORY NOTE.

The effect of these Regulations is to increase, in respect of the week ending 2nd December, 1988, the maximum weekly rate of maintenance allowances payable under section 44 of the Health Act 1947 and section 69 of the Health Act 1970 , by a sum equal to sixty five per cent of that amount.
