EUROPEAN COMMUNITIES (FRESH POULTRY MEAT) REGULATIONS 1988

I, MICHAEL O'KENNEDY, Minister for Agriculture and Food, in exercise of the powers conferred on me by section 3 of the European Communities Act, 1972 (No. 27 of 1972), and for the purposes of giving effect to Council Directive No. 85/326/EEC of 12 June 19851, hereby make the following regulations:

1. (1) These Regulations may be cited as the European Communities (Fresh Poultry Meat) Regulations, 1988.

(2) The European Communities (Fresh Poultry Meat) Regulations, 1976 to 1982, and these Regulations may be cited together as the European Communities (Fresh Poultry Meat) Regulations, 1976 to 1988, and shall be construed together as one.

2. In these Regulations "the Regulations of 1982" means the European Communities (Fresh Poultry Meat) Regulations, 1982 ( S.I. No. 274 of 1982 ).

3. The definition of "the Council Directive" in Regulation 2 (inserted by Regulation 4 of the Regulations of 1982) of the European Communities (Fresh Poultry Meat) Regulations, 1976 ( S.I. No. 317 of 1976 ), and in Regulation 3(1) of the Regulations of 1982 is hereby amended by the substitution in each Regulation for "and Council Directive No. 82/532/EEC of 19 July, 1982" of ",Council Directive No. 82/532/EEC of 19 July, 1982, and Council Directive No. 85/326/EEC of 12 June, 1985".

4. (1) A person who contravenes No. 11 (inserted by Council Directive No. 85/326/EEC of 12 June 19851) of Chapter III of Annex I of Council Directive No. 71/118/EEC of 15 February 19712 shall be guilty of an offence and shall be liable on summary conviction to a fine not exceeding £250 or imprisonment for a term not exceeding 6 months or both.

(2) Where there is a contravention of No. 12 (inserted by Council Directive No. 85/326/EEC of 12 June 19851) of Chapter III of Annex I of Council Directive No. 71/118/EEC of 15 February 19712 in relation to a person handling fresh poultry meat, the employer of that person shall be guilty of an offence and shall be liable on summary conviction to a fine not exceeding £500 or imprisonment for a term not exceeding 6 months or both.

EXPLANATORY NOTE.

These Regulations, which implement Council Directive 85/326/EEC, prohibit any person who is a possible source of contamination from working with or handling fresh poultry meat and require that persons employed to work with or handle fresh poultry meat, must produce an annual medical certificate to show that there is no impediment to such employment.
