ROAD TRAFFIC (CO-ORDINATION OF ROADWORKS) REGULATIONS, 1988.

The Minister for the Environment in exercise of the powers conferred on him by section 5 of the Road Traffic Act, 1961 (No. 24 of 1961) and section 101D of that Act as inserted therein by section 9 of the Dublin Transport Authority (Dissolution) Act, 1987 (No. 34 of 1987), hereby makes the following Regulations:—

1. These Regulations may be cited as the Road Traffic (Co-ordination of Road works) Regulations, 1988.

2. In these Regulations—

"the Act" means the Road Traffic Act, 1961 (No. 24 of 1961);

"Dublin Corporation" means the Right Honourable the Lord Mayor, Aldermen and Burgesses of Dublin;

"Dublin County Council" means the council of the administrative county of Dublin;

"Dún Laoghaire Corporation" means the borough of Dún Laoghaire established by the Local Government (Dublin) Act, 1930 .

3. Dublin Corporation shall be a local authority for the purposes of section 101D of the Act and may perform its functions under that section in the county borough of Dublin.

4. Dublin County Council shall be a local authority for the purposes of section 101D of the Act and may perform its functions under that section in the administrative county of Dublin excluding the borough of Dún Laoghaire.

5. Dún Laoghaire Corporation shall be a local authority for the purposes of section 101D of the Act and may perform its functions under that section in the borough of Dún Laoghaire.

EXPLANATORY NOTE.

The purpose of these Regulations is to designate Dublin Corporation, Dublin County Council and Dún Laoghaire Corporation as local authorities for the purposes of section 101D of the Road Traffic Act, 1961 (as inserted by section 9 of the Dublin Transport Authority (Dissolution) Act, 1987 ). This will enable these local authorities to exercise functions under section 101D and in particular to issue directions to persons undertaking roadworks on public roads in their functional areas in relation to such matters as the timing of roadworks and the manner in which roadworks should be carried out.
