PUBLIC ROADS (NOTICE OF DECLARATION) REGULATIONS, 1988.

The Minister for the Environment in exercise of the powers conferred on him by section 86 of the Local Government Act, 1925 (No. 5 of 1925) and section 2 of the Local Government Act, 1953 (No. 12 of 1953) hereby makes the following Regulations:—

1. These Regulations may be cited as the Public Roads (Notice of Declaration) Regulations, 1988.

2. The Public Roads (Notice of Declaration) Regulations, 1953 ( S.I. No. 166 of 1953 ) are hereby revoked.

3. The notice required to be published pursuant to sub-section (2) of section 2 of the Local Government Act, 1953 (No. 12 of 1953), of intention to consider the making of a declaration that a road shall be a public road, shall contain the following particulars:—

( a ) a statement of the intention of the road authority to consider the making of the declaration;

( b ) the time and place of the meeting of the road authority at which it is proposed to consider the making of the declaration;

( c ) in the case of a road within a housing estate, the name and location of the estate and the hours and place where a map indicating clearly the road to be declared a public road may be inspected by the public;

( d ) in every other case, the location, terminal points and length of the road.

EXPLANATORY NOTE.

A road authority is obliged under section 2 (2) of Local Government Act, 1953 to publish notice of intention to consider the making of a declaration of a road to be a public road. These regulations specify the amount of detail required to be published in the notice of intention in respect of housing estate and other roads. This Regulation revokes the Public Roads (Notice of Declaration) Regulations, 1953 ( S.I. No. 166 of 1953 ).
