EUROPEAN COMMUNITIES (SEED OF OIL PLANTS AND FIBRE PLANTS) (AMENDMENT) REGULATIONS, 1988.

I, MICHAEL O'KENNEDY, Minister for Agriculture and Food, in exercise of the powers conferred on me by section 3 of the European Communities Act, 1972 (No. 27 of 1972), and for the purpose of giving effect to Commission Directive 86/109/EEC of 27th February, 19861, in so far as it relates to seed of oil plants and fibre plants, hereby make the following Regulations:

1. (1) These Regulations may be cited as the European Communities (Seed of Oil Plants and Fibre Plants) (Amendment) Regulations, 1988, and shall come into operation on the 15th day of April, 1988.

(2) The European Communities (Seed of Oil Plants and Fibre Plants) Regulations, 1981 and 1983, and these Regulations may be cited together as the European Communities (Seed of Oil Plants and Fibre Plants) Regulations, 1981 to 1987, and shall be construed together as one.

2. In these Regulations "the Principal Regulations" means the European Communities (Seed of Oil Plants and Fibre Plants) Regulations, 1981 ( S.I. No. 38 of 1981 ).

3. Regulation 2 (1) of the Principal Regulations is hereby amended by the deletion of the words "or linseed" from the definition of "certified seed of the third generation".

4. Regulation 2 (2) of the Principal Regulations (as amended by the European Communities (Seed of Oil Plants and Fibre Plants) (Amendment) Regulations, 1983 ( S.I. No. 136 of 1983 ), and which specifies the directives, act and decision that have amended Council Directive69/208/EEC of 30th June 19692) shall be construed as if there were included therein a reference to Commission Directive 86/109/EEC of 27th February, 19861

EXPLANATORY NOTE.

The Regulations restrict the marketing of seed of linseed to pre-basic, basic and certified seed of the first and second generations subject to the conditions laid down under existing Regulations.
