AIR NAVIGATION AND TRANSPORT (PREINSPECTION) ACT, 1986 (COMPETENT AUTHORITY) ORDER, 1988.

I, JOHN P. WILSON, Minister for Tourism and Transport, in exercise of the powers conferred on me by section 2 of the Air Navigation and Transport (preinspection) Act, 1986 (No. 18 of 1986), and the Communications (Transfer of Departmental Administration and Ministerial Functions) (No. 2) Order, 1987 ( S.I. No. 92 of 1987 ), hereby order as follows:

1. This Order may be cited as the Air Navigation and Transport (preinspection) Act, 1986 (Competent Authority) Order, 1988.

2. This Order shall come into operation on the 25 day of March, 1988.

3. Aer Rianta Cuideachta Phoiblí Teoranta is hereby appointed to carry out the following functions of the Minister for Tourism and Transport as competent authority for the purpose of—

(a) the Air Navigation and Transport (Preinspection) Act, 1986 (No. 18 of 1986), and

(b) the Agreement, which is set out in the Schedule to the said Air Navigation and Transport (preinspection) Act, 1986 , and which relates to the preinspection in the State of persons (including aircrew) travelling by air to the United States of America, and which was made between the Government and the Government of the United States, and which was done at Dublin on the 25th day of June, 1986,

that is to say:—

(i) to agree with the Immigration and Naturalization Service as to the preinspection facilities to be provided at Shannon Airport in the county of Clare, and to arrange for the provision of such facilities;

(ii) to receive applications from, and to enter into such agreements as may be necessary with, any eligible air carrier who wishes to avail of preinspection, and any such agreements, so entered into, shall specify the terms and conditions under which preinspection will be carried out;

(iii) to consult, if and whenever necessary, with the Immigration and Naturalization Service on any matter relating to the practical implementation of the arrangements for preinspection at the said Shannon Airport.

EXPLANATORY NOTE.

The purpose of this Order is to delegate to Aer Rianta cpt. certain functions of the Minister for Tourism and Transport as competent authority under the Air Navigation and Transport (Preinspection) Act, 1986 , including the Agreement which is scheduled to that Act.
