HARBOUR RATES (NEW ROSS HARBOUR) ORDER, 1987.

I, BRENDAN DALY, Minister for the Marine, in exercise of the powers conferred on me by section 104 of the Harbours Act, 1946 (No. 9 of 1946), and the Communications (Transfer of Departmental Administration and Ministerial Functions) Order, 1987 ( S.I. No. 91 of 1987 ), and after due compliance with section 106 of the said Harbours Act, 1946 , hereby order as follows:

1. (1) This Order may be cited as the Harbour Rates (New Ross Harbour) Order, 1987.

(2) This Order shall come into operation on the 19th day of October, 1987.

2. In this Order—

"the Order of 1981" means the Harbour Rates (New Ross Harbour) Order, 1981 (S.I. No. 413 of 1981);

"the Order of 1982" means the Harbour Rates (New Ross Harbour) Order, 1982 ( S.I. No. 56 of 1982 ).

3. The Harbour Rates (New Ross Harbour) Order, 1949 ( S.I. No. 230 of 1949 ), is hereby amended—

( a ) by the substitution for paragraph (1) of Article 3 of the following paragraph:

"(1) The rates set out in the Schedules to this Order are hereby fixed as the rates to be charged by the New Ross Harbour Commissioners in respect of New Ross Harbour.",

( b ) by the substitution for the First Schedule (inserted by the Order of 1982) thereto of the following Schedule:

( a ) On every ton of the net register tonnage or half the gross tonnage whichever is the greater of every vessel discharging or loading in the harbour

( c ) On every ton of the net register tonnage or half the gross tonnage whichever is the greater of every vessel lying up in the harbour after the expiration of 2 days for each succeeding week or part thereof

On every river craft which plies regularly between any points in Waterford harbour and New Ross harbour or within the limits of New Ross harbour an annual sum payable yearly in advance on the 1st January of:

On every ton of the net register tonnage or half the gross tonnage whichever is the greater of every vessel, barge or lighter constructed in New Ross and exported through the port to any port or place

4.

On every passenger carrying vessel, other than seagoing passenger vessels, operating in the Port of New Ross an annual sum payable in advance on the 1st January of:

On every hired Cruiser entering or eaving the Port of New Ross a sum, for each entry or departure, of:

On every pleasure craft entering or leaving the Port of New Ross an annual sum payable in advance of 1st January of:

£9.00 per hour or so much of the remuneration of the Constable or Officer as is attributable to the time spent by him in attendance during the loading or discharging whichever is the greater sum.

2.

For the use of any wharf, pier, quay, shed or other storage area, for any period, for storage of any goods, for each week or part thereof, per tonne or per square metre at the option of the Commissioners

For the storage of imported fully built up motor vehicles in the Commissioners' Bonded Compounds per vehicle for the first 10.000 vehicles imported in any one year

Wharfage Rates

At the Commissioners' permanent wharves and jetties

50% of the appropriate goods rate.
