S.I. No. 152/1987 - Social Welfare (Rent Allowance) (Amendment) Regulations, 1987.

The Minister for Social Welfare in exercise of the powers conferred on him by section 23 of the Housing (Private Rented Dwellings) Act, 1982 (No. 6 of 1982) and subsections (2) and (3) of section 3 of the Social Welfare (Consolidation) Act, 1981 (No. 1 of 1981), hereby makes the following Regulations:—

1. (1) These Regulations may be cited as the Social Welfare (Rent Allowance) (Amendment) Regulations, 1987.

(2) These Regulations and the Social Welfare (Rent Allowance) Regulations, 1982 to 1986, may be cited together as the Social Welfare (Rent Allowance) Regulations, 1982 to 1987.

2. These Regulations shall come into operation on the 16th day of July, 1987.

3. In these Regulations—

"the Principal Regulations" means the Social Welfare (Rent Allowance) Regulations, 1982 (S.I. No. 200 of 1982);

"the Regulations of 1986" means the Social Welfare (Rent Allowance) (Amendment) Regulations, 1986 ( S.I. No. 218 of 1986 ).

4. The Principal Regulations (as amended by the R egulations of 1986) are hereby amended by—

(a) the substitution in article 5 (2) of "£96" for "£93", "£55" for "£53" and of "£4.10" for "£4" in each case in which the latter sum appears;

(b) by the deletion in article 5 (2) of "on or after the date on which the Act of 1982 comes into operation or by the Tribunal or by a rent officer on or after the date on which the Act of 1983comes into operation" and the substitution therefor of "or by the Tribunal or by a rent officer on or after 26 July, 1982".

(c) the substitution in article 5 (3) (a) of "£96" for "£93" and of "£106" for "£103" in each case in which the said sum appears;

(d) the substitution in article 5 (3) (b) of "£55" for "£53" and of "£60" for "£58" in each case in which the said sum appears;

(e) the substitution in article 6 (5) of "£8.40" for "£8.15", "£9.60" for "£9.30", "£7.50" for "£7.25" and "£6" for "£5.80".

EXPLANATORY NOTE.

These Regulations amend the conditions for receipt of a rent allowance in relation to the means test and calculation of the amount of an allowance, to take account of general increases in social welfare payments from July, 1987, and to ensure that the amount of allowance continues to be calculated by reference to the rent in force prior to 26th July, 1982.
