FOOD HYGIENE REGULATIONS, 1950 (SHELLFISH CONTROLLED AREA) ORDER, 1987

The Minister for Health, in exercise of the powers conferred on him by article 55 of the Food Hygiene Regulations, 1950 ( S.I. No. 205 of 1950 ) hereby orders as follows:—

1. This Order may be cited as the Food Hygiene Regulations, 1960 (Shellfish Controlled Area) Order, 1987.

2. This Order shall come into operation on the 1st day of May, 1987.

3. The area specified in the Schedule hereto is hereby declared to be a controlled area for the purposes of Part VI of the Food Hygiene Regulations, 1950.

SCHEDULE

Controlled Area

The portion of the sea including inlets and harbours, the strands and tidal waters forming part of the functional area of the Southern Health Board which lies within the area enclosed by a line drawn from Relane Point in the townland of Dromclogh in the County of Cork to West Battery in the townland of Reenaknock on Whiddy Island in the County of Cork and a line drawn from Eagle Point in the townland of Reenadisert in the County of Cork to Whiddy Point East in the townland of Reenavanny on Whiddy Island in the County of Cork.

EXPLANATORY NOTE.

The effect of this Order is to declare an area of Bantry Bay between a line drawn from Relane Point in the townland of Dromclogh in the County of Cork to West Battery in the townland of Reenaknock on Whiddy Island in the County of Cork and a line drawn from Eagle Point in the townland of Reenadisert in the County of Cork to Whiddy Point East in the townland of Reenavanny on Whiddy Island in the County of Cork to be a controlled area for the purposes of Part VI of the Food Hygiene Regulations, 1950. To sell, offer for sale or have possession of for the purpose of sale of shellfish for human consumption from this area is thereby prohibited unless treated in a manner approved by the local Director of Community Care and Medical Officer of Health. The local Director of Community Care and Medical Officer of Health is also empowered to approve, or withdraw approval, of sites for the relaying of shellfish and any person selling, offering for sale or having possession of for the purpose of sale is required to keep appropriate records.
