S.I. No. 46/1987 - Courts-Martial (Legal Aid) Regulations, 1987


I, PADDY O`TOOLE, Minister for Defence, in exercise of the powers conferred on me by section 33 of the Courts Martial Appeals Act, 1983 (No. 19 of 1983), and in so far as these Regulations are in relation to rates or scales of payment of fees, costs or expenses payable out of monies provided by the Oireachtas pursuant to legal aid certificates, with the consent of the Minister for Finance, hereby make the following Regulations:—

1. (1) These Regulations may be cited as the Courts-Martial (Legal Aid) Regulations, 1987.

(2) The Principal Regulations and these Regulations may be cited together as the Courts Martial (Legal Aid) regulations, 1986 and 1987.

2. In these Regulations "the Principal Regulations" means the Courts-Martial (Legal Aid) Regulations, 1986 ( S.I. No. 425 of 1986 ).

3. The Principal Regulations are hereby amended with effect from the 1st day of January, 1987—

(a) by the substitution in Regulation 12 (2) (a) of "£94.94" for "£93.06" and of "£42.20" for £41.38", and

(b) by the substitution in Regulation 14 of "£24.60" for "£24.12".

4. The Principal Regulations are hereby amended with effect from the 1st day of May, 1987—

(1) by the substitution in Regulation 12 (2) (a) of "£96.82" for "£94.94" and of "£43.06" for "£42.20", and

(2) by the substitution in Regulation 14 of "£25.10" for "£24.60".

EXPLANATORY NOTE.

These Regulations provide for increases with effect from 1st January, 1987 and 1st May, 1987 in the legal aid fees payable to solicitors in respect of certain attendances at courts-martial and visits to prisons, detention barracks and other custodial centres.
