SEA FISHERIES (CONTROL OF CATCHES) ORDER, 1985 (AMENDMENT) ORDER, 1986.

I, LIAM KAVANAGH, Minister for Tourism, Fisheries and Forestry, in exercise of the powers conferred on me by section 223A (inserted by section 9 of the Fisheries (Amendment) Act, 1978 (No. 18 of 1978), and amended by section 4 of the Fisheries (Amendment) Act, 1983 (No. 27 of 1983)) of the Fisheries (Consolidation) Act, 1959 (No. 14 of 1959), and the Fisheries (Transfer of Departmental Administration and Ministerial Functions) Order, 1977 ( S.I. No. 30 of 1977 ) (as adapted by the Fisheries and Forestry (Alteration of Name of Department and Title of Minister) Order, 1986 ( S.I. No. 40 of 1986 )), hereby order as follows:

1. This Order may be cited as the Sea Fisheries (Control of Catches) Order, 1985 (Amendment) Order, 1986.

2. The Sea Fisheries (Control of Catches) Order, 1985 ( S.I. No. 163 of 1985 ), is hereby amended by the substitution for the definition in Article 2 of "the Council Regulation" of the following definition—

"the Council Regulation" means Council Regulation (EEC) No. 2057/82 of 29 June, 19822, as amended by Council Regulation (EEC) No. 1729/83 of 20 June, 19833, and by Council Regulation 3723/85 of 20 December, 19854".

EXPLANATORY NOTE.

The effect of this Order is to make any infringement of Council Regulation (EEC) 3723/85 (which extends the operation of the EEC logbook system to include records of transhipments to and from vessels in Irish and Foreign waters, including to and from processing vessels and to ensure comprehensive reports of transhipments by skippers of fishing vessels and fish processing vessels) an offence in so far as the Regulation applies within the jurisdiction of the State or to an Irish sea fishing boat.
