EUROPEAN COMMUNITIES (CONSERVATION OF WILD BIRDS) (AMENDMENT) REGULATIONS, 1986.

I. LIAM KAVANAGH, Minister for Tourism, Fisheries and Forestry, in exercise of the powers conferred on me by section 3 of the European Communities Act, 1972 (No. 27 of 1972), and for the purpose of giving effect to Council Directive No. 79/409/EEC of 2 April, 1979¹ hereby make the following Regulations:

1. (1) These Regulations may be cited as the European Communities (Conservation of Wild Birds) (Amendment) Regulations, 1986.

(2) These Regulations shall come into operation on the 28th day of February, 1986.

2. The Schedule to the European Communities (Conservation of Wild Birds) Regulations, 1985, ( S.I. No. 291 of 1985 ), is hereby amended by the addition of the following sites to the sites listed therein:—

"5. The area known as the Cliffs of Moher in the county of Clare following the line of the cliff top from the boundary of the townlands of Ballylaan and Ballyherragh in the south to the boundary of the townlands of Lough South and Lough North in the north and extending two metres from the cliff top on the landward side and two hundred metres from the dliff face on the seaward side.

6. The North Bull Island, Dollymount, in the County Borough of Dublin. The area within the County Borough of Dublin which is enclosed by an imaginary line drawn from the south-eastern end of the Bull Wall, proceeding along the north-eastern side of the Bull Wall until it reaches Clontarf Road, then turning north-east along the south-eastern side of Clontarf Road to a point 533 yards west of Sutton cross roads, then following the coast line in a south-easterly direction to a point 633 yards southeast of Sutton Criss where it reached Strand Road, then continuing in a south-easterly and southerly direction along the coast side of Strand Road to the southern end of Martello Terrace, then leaving the road and continuing south along the coast line to a point 87 yards south of the Martello tower, and thence going direct to the southeastern end of the Bull Wall.

7. The area comprising the islands situated in the county of Kerry and known as Great Skellig and Little Skellig.

8. The area comprising the islands situated in the county of Kerry and known as Inishvickillane, Inishnabro, Inishtooskert, Beginish and Teraght Island.

9. The area comprising the lake in the townland of Lady's Island in the county of Wexford and known as Lady's Island Lake.

10. The area comprising the islands in the townland of Lady's Island in the county of Wexford and known as Inish and Sgarbheen.

11. The area comprising the lake in the barony of Corkaguiny in the county of Kerry and known as Lough Gill.

12. The area known as Horn Head in the county of Donegal following the line of the cliff top from the boundary of the townlands of Pollaguill and Cleggan on the west to the point known as Ross Glen in the townland of Muntermellan on the east and extending two metres from the cliff top on the landward side and two hundred metres from the cliff face on the seaward side.

13. That portion of Drumcliff Bay (including Lissadell Strand) in the county of Sligo which is bounded on the west, north and east by the High Water Mark and on the south by an imaginary line drawn from Raghly Point to the southernmost point of the townland of Finned, together with the lands comprising the townlands of Finned, and Ballygilgan in the county of Sligo, and the lands in the townland of Lissadill known as Ardgarran Wood in the county of Sligo and which at the date of these Regulations are in possession of the Minister for Tourism, Fisheries and Forestry together with the lands comprising the part of the townland of Doonfore in the county of Sligo which is bounded on the west by the townland boundary, on the south by the High Water Mark, on the east by the passage on or adjacent to which are Bench Marks 19.6, 21.3 and 21 and on the north by the northern boundary of the field immediately west of Bench Mark 21.".

EXPLANATORY NOTE.

E.E.C. Directive No. 79/409 on the Conservation of Wild Birds provides for the conservation of populations of wild birds by, among other things, classifying important ornithological sites as special protection areas for them. The effect of these Regulations is to classify nine sites as special protection areas and to provide that contravention of the provisions of these Regulations shall constitute an offence.
