S.I. No. 8 of 1986.

ROAD TRAFFIC (SPEED LIMITS) (COUNTY BOROUGH OF WATERFORD AND COUNTY OF WATERFORD) REGULATIONS, 1986.

The Minister for the Environment in exercise of the powers conferred on him by sections 5 and 45 of the Road Traffic Act, 1961 (No. 24 of 1961) and section 46 of the said Act as amended by section 25 of the Road Traffic Act, 1968 (No. 25 of 1968) hereby makes the following Regulations:

1 Citation.

1. These Regulations may be cited as the Road Traffic (Speed Limits) (County Borough of Waterford and County of Waterford) Regulations, 1986.

2 Commencement.

2. These Regulations shall come into operation on the 27th day of January, 1986.

3 Interpretation.

3. In these Regulations save where the context otherwise requires

"the Act" means the Road Traffic Act, 1961 ;

"distance" means distance as measured along the centre line of a road;

"national road" means a road declared to be a national road in the Local Government (Roads and Motorways) Act, 1974 (Declaration of National Roads) Order, 1977 ( S.I. No. 164 of 1977 ) and any reference to the number of such road shall be a reference to the number of such road as shown in column 1 of the First Schedule or column 1 of the Second Schedule to the aforementioned Order;

"perimeter road" means a road on and along the roadway of which there runs the boundary of a town;

"road" means a public road;

"special speed limit" and "built-up area speed limit" have the meanings respectively assigned to them in Part IV of the Act;

4 Built-up area speed limit.

4. (1) Each of the roads described in the First Schedule to these Regulations is hereby declared not to be a public road in a built-up are for the purposes of section 45 of the Act.

(2) Each of the roads described in the Second Schedule to these Regulations is hereby declared to be a public road in a built-up area for the purposes of section 45 of the Act.

5 Special speed limit.

5. Forty miles per hour shall be the speed limit for mechanically propelled vehicles on the roads specified in the Third Schedule to these Regulations.

6 Exceptions.

6. There shall be excepted from the special speed limit prescribed in article 5 of these Regulations and from the built-up area speed limit the following:—

( a ) ambulances,

( b ) fire brigade vehicles, and

( c ) vehicles used by members of the Garda Síochána in the performance of their duties as such members.

7 Revocation.

7. The Road Traffic (Speed Limits) (County Borough of Waterford and County of Waterford) Regulations, 1979 ( S.I. No. 50 of 1979 ) are hereby revoked.

FIRST SCHEDULE

Roads in the County Borough of Waterford and County of Waterford declared not to be public roads in a built-up area for the purposes of section 45 of the Road Traffic Act, 1961 .

1. The following roads in the Urban District of Dungarvan:

( a ) Boreen a 'Willan, the Kilrush Graveyard Road, the Lisfennel Road, the Knockateemore Road, the road connecting Kilrush Graveyard Road with the Apple Factory Road.

( b ) The Waterford (coast) Road for a distance of 1,400 metres from the urban district boundary.

( c ) The main Waterford Road (National Road N25) between the point where the urban district boundary intersects the western side of the road and a point 250 metres north-east of its junction with the Waterford (coast) Road.

( d ) The Old Hospital Road for a distance of 233 metres from the urban district boundary.

( e ) The Shandon Road between the point where the urban district boundary intersects the eastern side of the road at Ballyneety Bridge and a point 200 metres north-west of its junction with the Cork-Waterford Road (National Road N25).

( f ) The Cappoquin Road for a distance of 924 metres from the point where the urban district boundary intersects the southern side of the road.

( g ) The Apple Factory Road other than that part of the said road between its junction with the Cappoquin Road and a point 60 metres from the said junction.

( h ) The Youghal Road (National Road N25) for a distance of 242 metres from the urban district boundary.

( i ) The Knockbrack Road between the point where the urban district bounday intersects the eastern side of the road and a point 180 metres from its junction with Father Toomey's Road.

( j ) The Mapestown Road between the point where the urban district boundary intersects the northern side of the road and a point 369 metres north west of its junction with Father Toomey's Road.

2. The following roads in the town of Lismore:

( a ) The Cappoquin Road (National Road N72) between the town boundary and a point 75 metres north of its junction with Main Street.

( b ) Ferry Lane between its junction with the Cappoquin Road (National Road N72) and a point 118 metres north of its junction with Main Street.

3. The following roads in the town of Tramore:

( a ) The Glen Road, The Kilfarrasy Road, The Metal Man Road.

( b ) The main Waterford Road between the town boundary and a point 95 metres north-east of its junction with the Old Riverstown Road.

( c ) The Old Waterford Road between its junction with the main Waterford Road and a point 353 metres north-east of its junction with the Racecourse Road.

( d ) The Carrick Road between the town boundary and a point 254 metres north of its junction with the Racecourse Road.

( e ) The Knockanduff Road between the town boundary and a point 938 metres west of its junction with Priest's Road.

( f ) The Bonmahon Road between the town boundary and a point 147 metres north-east of its junction with the Kilfarrasy Road.

( g ) The Newtown Road between its junction with the Metal Man Road and a point 300 metres south-east of its junction with the Bonmahon Road.

4. The following roads in the County Borough of Waterford:

( a ) The Knockhouse Road, Quarry Road, the Lacken Road, the Ballindud Road, the Green Road.

( b ) The Lower Grange Road for a distance of 1,620 metres from the county borough boundary.

( c ) The Tramore Road between the point where the county borough bounday intersects the eastern side of the road and a point 205 metres from its junction with the Cork Road (National Road N25).

( d ) The Cleaboy Road between the county borough boundary and a point 1,440 metres south-west of the westernmost entrance road to Marian Park.

( e ) The Cork Road (National Road N25) between the county borough boundary and a point 55 metres south-west of its junction with the O'Reilly Road.

( f ) The Gracedieu Road other than that part of the said road between its junction with the Knockhouse Road and a point 183 metres south-east of the said junction.

( g ) The Bilberry Road other than that part of the said road between its junction with Waterford Bridge and a a point 311 metres north-west of the said junction.

( h ) The Dunmore Road between the county borough boundary and a point 905 metres south-east of its junction with Maypark Lane.

( i ) The Old Tramore Road between the point where the county borough boundary intersects the western side of the road and a point 1,200 metres south of its junction with Pearse Park.

( j ) The Knockboy Road for a distance of 10 metres from its junction with the Dunmore Road.

( k ) The Kilcaragh Cross Road between the county borough boundary and a point 310 metres south-east of its junction with the Williamstown Cross-Callaghane Bridge road.

( l ) The Williamstown Cross-Callaghane Bridge road for a distance of 50 metres northwards from the point where the county borough boundary intersects the north-eastern side of the road.

( m ) The Monamintra Cross Road between its junction with the Kilcaragh Cross Road and a point 183 metres south-west of its junction with the Williamstown Cross-Callaghane Bridge road.

( n ) All roads in the added area described in the First Schedule to the County Borough of Waterford (Extension of Boundary) Provisional Order, 1979 as confirmed by the Local Government Provisional Order Confirmation Act, 1979 (Number 2 (Private) of 1979),other than those roads or parts thereof in the said area which are described at references (a) to (m) inclusive.

SECOND SCHEDULE

Roads in the County of Waterford declared to be public roads in a built-up area for the purposes of section 45 of the Road Traffic Act, 1961 .

1. The following roads at Aglish:

( a ) The Coolroe-Villierstown road between a point 204 metres north of the centre line of Coolroe Bridge and a point 676 metres north-west of the said centre line.

( b ) The Ballynaparka Road between its junction with the Cappoquin Road and a point 136 metres south of the centre Line of Ballynaparka Bridge.

( c ) The Cappoquin Road between its junction with the Coolroe-Villiarstown road and a point 191 metres north-east of its junction with the Ballynaparka Road.

( d ) The road connecting the Cappoquin Road with the Villierstown Road.

( e ) The Clashmore Road.

2. The following roads at Annestown:

( a ) The Tramore-Dungarvan (coast) road between the eastern end of Annestown Bridge and a point 75 metres west of its junction with the Ballyheadon Road.

( b ) The Ballyheadon Road for a distance of 100 metres from its junction with the Dungarvan (coast) Road.

( c ) The Dunhill Dispensary Road for a distance of 98 metres from its junction with the Tramore Road.

3. The following roads at Ardmore:

( a ) The Cliff Road, Coffey Lane, Main Street, the Rocky Road, St. Declan's Row, Tower Hill.

( b ) Dawson's Road and the road connecting it with the Cliff Road.

( c ) The Dungarvan Road for a distance of 153 metres from its junction with Main Street.

( d ) The Youghal Road for a distance of 539 metres from its junction with Tower Hill.

( e ) The Ardoginna Road for a distance of 80 metres from its junction with Tower Hill.

4. The following roads at Ballyduff:

( a ) The Fermoy-Lismore road between a point 30 metres north-west of its junction with the Tallow Road and a point 182 metres east of the said junction.

( b ) The Tallow Road for a distance of 222 metres from its junction with the Fermoy-Lismore road.

( c ) The Barnavalla Road for a distance of 97 metres from its junction with the Fermoy-Lismore road.

( d ) The Ballinvilla Road for a distance of 10 metres from its junction with the Fermoy-Lismore road.

5. The following roads at Bonmahon:

( a ) The Glebe Road.

( b ) The Dungarvan-Tramore (coast) road between a point 238 metres north-west of its junction with Barrack Hill and a point 35 metres east of its junction with the Ballynasissla Road.

( c ) The Ballynasissla Road for a distance of 57 metres from its junction with the Tramore-Dungarvan (coast) road.

( d ) Barrack Hill for a distance of 240 metres from its junction with the Tramore-Dungarvan (coast) road.

6. The following roads at Cappoquin:

( a ) Castle Street, Green Street, Mass Lane, Mill Street, O'Donoghue's Terrace, Twig Lane, Church Street.

( b ) The Lismore-Dungarvan road (National Road N72) between a point 42 metres south-east of its junction with the Camphire or Rock Road and a point 176 metres south of its junction with Mill Street.

( c ) The Mount Melleray Road for a distance of 1,255 metres from the junction of Barrack Street with the Lismore-Dungarvan road (National Road N72).

7. The following roads at Cheekpoint:

( a ) The Russian Side, Dock Road, The Mount, Strand Road, The Rockery, Power's Hill, The Street, the County Council housing estate road.

( b ) The Faithlegg Bridge Road between its junction with the Mount and a point 182 metres south of its junction with The Street.

8. The following roads at Clashmore:

( a ) Khakitown Road.

( b ) The Clonmel-Youghal road between a point 408 metres north-east of its junction with Kilmore Road and a point 101 metres south-east of its junction with the Hill Road.

( c ) The Kilmore Road for a distance of 320 metres from its junction with the Clonmel-Youghal road.

( d ) The Hill Road for a distance of 265 metres from its junction with the Clonmel-Youghal road.

( e ) The Dungarvan (Mountain) Road for a distance of 201 metres from its junction with the Clonmel-Youghal road.

9. The following roads adjacent to the Urban District of Dungarvan:

( a ) The Mapestown Road for a distance of 369 metres from its junction with Father Toomey's Road.

( b ) The Knockbrack Road for a distane of 180 metres from its junction with the Father Toomey's Road.

( c ) The road connecting the Knockbrack Road with the Twomilebridge Road.

( d ) The Twomilebridge Road for a distance of 105 metres from its junction with the Mapestown Road.

10. The following roads at Dunmore East:

( a ) The Circular Road, King's Terrace, Long's Hill, Nymphall Road, Park Road, Sunnyside, Marian Terrace, Wellington Terrace, Horsequarter Road.

( b ) Killea Road for a distance of 890 metres from its junction with Horsequarter Road.

( c ) The Waterford Road for a distance of 470 metres from its junction with Ballymacaw Road.

( d ) Ballymacaw Road for a distance of 107 metres from its junction with Waterford Road.

( e ) Dock Road and its continuation southwards to a point 60 metres north of the junction of the said continuation with Red Road.

11. The following roads at Kill:

( a ) The Carrigeen-Bonmahon road between a point 210 metres north-east of its junction with the Ballylaneen-Dunhill road and a point 300 metres south of the said junction.

( b ) The Ballylaneen-Dunhill road between a point 240 metres north-west of its junction with the Carrigeen-Bonmahon road and a point 120 metres east of the said junction.

12. The following roads at Kilmacthomas:

( a ) High Lane, High Street, Main Street, The Square, St. Anne's Terrace, Walsh's Place, Hillside Cresent, Western Terrace, Riverside housing estate road.

( b ) The Carrick New Line for a distance of 50 metres from its junction with Main Street.

( c ) The Graigue Road between its junction with the Newton Road and a point 20 metres north-east of its junction with High Lane.

( d ) The Newtown Road between its junction with Main Street and a point 439 metres east of its junction with the Graigue Road.

( e ) The road to the New Bridge for a distance of 340 metres from its junction with Main Street.

( f ) The Well Road for a distance of 340 metres from its junction with the Dungarvan Road.

( g ) The Dungarvan Road for a distance of 536 metres from its junction with Main Street.

( h ) The Currabaha Road for a distance of 215 metres from its junction with the Dungarvan Road.

13. The following roads adjacent to the town of Lismore:

( a ) The Parks Road, Hospital Lane, Parks Road housing scheme cul-de-sac, Townparks housing scheme cul-de-sac.

( b ) The Deerpark Road for a distance of 265 metres from its junction with the Convent Road.

( c ) The Convent Road for a distance of 218 metres from the point where the boundary of the town of Lismore intersects the southern side of the road.

( d ) The Mayfield Road where the said road is a perimeter road.

( e ) Chapel Street and its continuation as the Union Road between the point where the boundary of the town of Lismore intersects the eastern side of the road and a point 38 metres south-west of the junction of Union Road with Townparks housing scheme cul-de-sac.

( f ) The Ballyanchor Road between the point where the town boundary intersects the eastern side of the road and a point 140 metres east of its junction with New Street.

( g ) The Tallow Road for a distance of 216 metres south-west of its junction with the Ballyanchor Road.

14. The following roads at Passage East:

All roads in the area enclosed by a line comencing at a point on the Waterford Road 166 metres north-west of its junction with Barrack Square and drawn thence in straight lines successively to the following points:—

( a ) the eastern terminal point of the Custom House Quay,

( b ) the eastern terminal point of the Breakwater,

( c ) a point on the Woodstown Road 233 metres south of its junction with Dobbyn Street,

and from the last-mentioned point in a straight line to the commencement point on the Waterford Road.

15. The following roads at Portlaw:

All roads in the area enclosed by a line commencing at a point on the eastern edge of the Carrick Road 327 metres north of its junction with Connolly Road and drawn thence in straight lines successively to the following points:—

( a ) a point on the Priest's Road 470 metres east of its junction with the Carrick Road,

( b ) a point on the Waterford Road 105 metres east of its junction with the Kilmacthomas Road,

( c ) a point on the Kilmacthomas Road 137 metres south of the centre point of Portlaw Bridge,

( d ) the westernmost point of Bridge Street,

( e ) a point on the Factory Road 74 metres west of its junction with Church Road.

( f ) a point on Piggot's Cross Road 148 metres north-west of its junction with Connolly Road.

and from the last mentioned point in a straight line to the commencement point on the Carrick Road.

16. The following roads at Rathgormuck:

( a ) The Clonmel-Feddans road between a point 310 metres north-west of its junction with the Graveyard Road and a point 303 metres south-east of the said junction.

( b ) The Graveyard Road for a distance of 160 metres from its junction with the Clonmel-Feddans road.

( c ) The Ballythomas Road for a distance of 192 metres from its junction with the Clonmel-Feddans Road.

17. The following roads at Stradbally:

( a ) The Square, Church Lane, the County Council housing estate roads north-west of the Old Coast Road.

( b ) The Kilmacthomas Road for a distance of 239 metres from its junction with the Square.

( c ) High Street and its continuation as the Old Coast Road for a distance of 475 metres from the junction of High street with the Cove Road.

( d ) Nunnery Lane for a distance of 215 metres from its junction with the Cove Road.

( e ) Cove Road between its junction with High Street and a point 43 metres south of its junction with Nunnery Lane.

18. The following roads at Tallow:

All roads in the area enclosed by a line commencing at a point on the Lismore Road 658 metres north of its junctionwith Chapel Street and drawn thence in straight lines successively to the following points:—

( a ) a point on Townparks Road 805 metres east of the junction of Chapel Street with the Lismore Road,

( b ) a point on the Youghal Road 205 metres south-east of its junction with Kilcalf Road,

( c ) a point on the Kilcalf Road 220 metres south of its junction with the Youghal Road,

( d ) a point on the Midleton Road 60 metres south of its junction with Cockpit Lane,

( e ) a point on West Street 673 metres west of its junction with the Lismore Road

and from the last-mentioned point in a straight line to the commencement point on the Lismore Road.

19. The following roads at Villierstown:

( a ) The Ferry Road, The Pill Road, The Link Road, The Green.

( b ) The Aughaclareen Bridge-Dromana Forest road between a point 155 metres south-east of its junction with the Kereen Road and a point 486 metres north-west of the said junction.

( c ) The Kereen Road for a distance of 340 metres from its junction with the Aughaclareen Bridge-Dromana Forest road.

( d ) The Ballyingowan Road for a distance of 103 metres from its junction with the Aughaclareen Bridge-Dromana Forest road.

THIRD SCHEDULE

Roads in the County Borough of Waterford and County of Waterford in respect of which a special speed limit of 40 miles per hour is prescribed.

1. The following roads at Ballymacarbry:

( a ) The Dungarvan-Clonmel Road between a point 50 metres south-east of its junction with the Nire Road and a point 1,408 metres north-west of the said junction.

( b ) The Nire Road for a distance of 60 metres from its junction with the Clonmel-Dungarvan road.

2. The following roads in the Urban District of Dungarvan:

( a ) The Waterford (coast) Road between a point 1,400 metres south-west of the urban district boundary and a point 841 metres south-west of the said boundary.

( b ) The Waterford Road (National Road N25) between a point 250 metres north-east of its junction with the Waterford (coast) Road and a point 60 metres south-west of its junction with Boreen a 'William.

( c ) The Youghal Road (National Road N25) between a point 45 metres south-west of the urban district boundary and a point 240 metres north-east of the said boundary.

( d ) The Cappoquin Road between a point 11 metres south-east of its junction with the Kilrush Graveyard Road and a point 924 metres from the point where the urban district boundary intersects the southern side of the road.

( e ) The Lisfennel Road for a distance of 40 metres from its junction with the Youghal Road (National Road N25).

3. The following roads at Dunmore East:

( a ) The Waterford Road between a point 470 metres north-west of its junction with the Ballymacaw Road and a point 810 metres north-west of the said junction.

( b ) The Ballymacaw Road between a point 107 metres south-west of its junction with the Waterford Road and a point 464 metres south-west of the said junction.

( c ) The continuation southwards of Dock Road between a point 60 metres north of its junction with the Red Road and a point 510 metres west of the said junction.

4. The following roads at Kilmeaden:

( a ) The Dungarvan-Waterford road (National Road N25) between a point 125 metres south-east of its junction with Carrick-on-Suir Road and a point 1,055 metres south-east of the said junction.

( b ) The Blackrock Road for a distance of 85 metres from its junction with the Dungarvan-Waterford road (National Road N25).

( c ) The Lacka Road for a distance of 30 metres from its junction with the Dungarvan-Waterford Road (National Road N25).

5. The following roads at Lemybrien:

( a ) The Dungarvan-Waterford road (National Road N25) between a point 157 metres south-west of the centre line of the River Deehil Bridge and a point 767 metres north-east of the said centre line.

( b ) The Carrick-on-Suir Road for a distance of 757 metres from its junction with the Dungarvan-Waterford road (National Road N25).

( c ) The Kilrossanty-Adramone road between a point 137 metres north-west of its junction with the Carrick-on-Suir Road and a point 155 metres south-east of its junction with the Dungarvan-Waterford road (National Road N25).

( d ) The Barnakile Road for a distance of 182 metres from its junction with the Dungarvan-Waterford road (National Road N25).

6. The following roads in the County Borough of Waterford:

( a ) The Dunmore Road between a point 905 metres south-east of its junction with Maypark Lane and a point 2,330 metres south-east of the said junction.

( b ) The Cork Road (National Road N25) between a point 55 metres south-west of its junction with the O'Reilly Road and a point 458 metres south-west of its junction with Brown's Road.

( c ) The Lacken Road for a distance of 46 metres from Kilbarry Crossroads.

( d ) The Tramore Road between a point 205 metres from its junction with the Cork Road (National Road N25) and a point 1,150 metres from the said junction.

( e ) The Knockboy Road for a distance of 10 metres from its junction with Dunmore Road.

( f ) The Old Tramore Road between its junction with the Ballindud Road and a point 1,200 metres south of its junction with Pearse Park.

EXPLANATORY NOTE.

These Regulations replace the Road Traffic (Speed Limits) (County Borough of Waterford and County of Waterford) Regulations, 1979 ( S.I. No. 50 of 1979 ) and alter the speed limits applicable to certain roads in these areas.

The Regulations exclude the public roads mentioned in the First Schedule from the scope of the built-up area speed limit of 30 mph prescribed by section 45 of the Road Traffic Act, 1961 , thus enabling a special speed limit of 40 mph to be applied to some of these roads.

The Regulations declare that the roads mentioned in the Second Schedule which would otherwise be outside the scope of the build-up area speed limit of 30 mph shall be subject to that limit.

These Regulations prescribe a speed limit of 40 mph in respect of the public roads mentioned in the Third Schedule.

Ambulances, fire brigade vehicles and Garda Síochána vehicles while being used in the course of duty are excepted from all speed limits by the Regulations.
