Courts Act, 1986

Amendment of Courts of Justice Act, 1936.

1.—(1) The Courts of Justice Act, 1936 , is hereby amended by—

(a) the insertion in the Second Schedule of

Galway

Galway County Borough

after

Galway

Galway county

and

(b) the insertion in section 33, with effect as on and from the 1st day of January, 1986, of the following paragraph after paragraph (a) of subsection (2):

“(aa) alter the composition of a High Court Circuit by adding to or removing from the Circuit a county or counties, a county borough or county boroughs or a county or counties and a county borough or county boroughs, or”.

(2) (a) Galway is hereby deemed to be the appeal town, within the meaning of Part IV of the Courts of Justice Act, 1936 , for the purposes of appeals from judgments or orders of the Circuit Court given or made in actions or matters heard and determined before the passing of this Act in the County Borough of Galway or before the 1st day of January, 1986, in the area that, upon that date, constituted the said County Borough.

(b) A notice of appeal served before such passing in respect of a judgment or order referred to in paragraph (a) of this subsection shall not be invalid by reason only of the fact that an appeal town, within the meaning aforesaid, for the County Borough of Galway did not stand specified, or that paragraph (a) of this subsection was not in force, at the time of such service.
