REGISTRATION OF ELECTORS (AMENDMENT) REGULATIONS, 1985.

The Minister for the Environment, in exercise of the powers conferred on him by sections 5 and 7 of the Electoral Act, 1963 (No. 19 of 1963) as amended by section 4 of the Juries Act, 1976 (No. 4 of 1976) and as adapted by the Local Government (Alteration of Name of Department and Title of Minister) Order, 1977 ( S.I. No. 269 of 1977 ), section 3 of the European Assembly Elections Act, 1977 (No. 30 of 1977) and section 5 of the Electoral (Amendment) Act, 1985 (No. 12 of 1985), hereby makes the following Regulations, a draft of which has been approved by a resolution passed by each House of the Oireachtas:

1. These Regulations may be cited as the Registration of Electors (Amendment) Regulations, 1985.

2. The Registration of Electors Regulations, 1963 and 1977, and these Regulations shall be construed as one and may be cited together as the Registration of Electors Regulations, 1963 to 1985.

3. In these Regulations—

"the Principal Regulations" means the Registration of Electors and Juries Acts (Specification of Dates) Regulations, 1963 ( S.I. No. 169 of 1963 ) as amended by the Registration of Electors (Amendment) Regulations, 1977 ( S.I. No. 381 of 1977 ).

4. Article 3(1) of the Principal Regulations is hereby amended by

( a ) the insertion in the definition of "elector" before "a Dáil elector" of "a presidential elector, ";

( b ) the substitution for the definition of "the register" of the following: " 'the register' means, as the context may require, the register of presidential, Dáil, European Assembly and local government electors or the register of presidential electors or the register of Dáil electors or the register of European Assembly electors or the register of local government electors and, where the context so requires, includes the postal voters list;" and

( c ) the addition of the following definition—

"'Dáil constituency' means a constituency for which candidates may be elected at a Dáil election.".

5. Article 4(3) of the Principal Regulations is hereby amended by the addition of the words "and section 3 of the European Assembly Elections Act, 1977 , and section 5 of the Electoral (Amendment) Act, 1985 ".

6. The Principal Regulations are hereby amended by the substitution for article 6 of the following article:

"6. The parts of the register for the polling districts in a Dáil constituency, so far as they relate to presidential electors, shall be the register of presidential electors for that constituency and, so far as they relate to Dáil electors, shall be the register of Dáil electors for that constituency and the parts of the register for the polling districts in a European Assembly constituency, so far as they relate to European Assembly electors, shall be the register of European Assembly electors for that constituency and the parts of the register for the polling districts in a local electoral area, so far as they relate to local government electors, shall be the register of local government electors for that area.".

7. Article 8(3) of the Principal Regulations is hereby amended by the insertion after paragraph (b) of the following paragraph—

"(bb) to provide documentary evidence or to make a statutory declaration that he is a person entitled to be registered as a Dáil elector under section 5 (1A) of the Electoral Act, 1963 (inserted by section 2 of the Electoral (Amendment) Act, 1985 );".

8. Article 9(1)(b) of the Principal Regulations is hereby amended by the insertion of "Dáil" before "constituency" where it first occurs.

9. Article 16(4)(b) of the Principal Regulations is hereby amended by the insertion of "Dáil" before "constituency" where it first occurs.

10. Article 18(4)(a) and (b) of the Principal Regulations is hereby amended by the insertion of "Dáil" before "constituency" in each place where it occurs.

11. The following forms are hereby substituted for Form R.F.1 and Form R.F.2, respectively, in the First Schedule to the Principal Regulations:

EXPLANATORY NOTE.

These Regulations amend the principal forms to be used in the registration of persons as electors and make other minor technical amendments to the Registration of Electors Regulations, 1963 and 1977, consequent on the enactment of the Electoral (Amendment) Act, 1985 .
