EUROPEAN COMMUNITIES (NAMES & LABELLING OF TEXTILE PRODUCTS) (AMENDMENT) REGULATIONS, 1985.

I, JOHN BRUTON, Minister for Industry, Trade, Commerce and Tourism, in exercise of the powers conferred on me by section 3 of the European Communities Act, 1972 (No. 27 of 1972), and for the purpose of giving effect to Council Directive No. 83/623/EEC of 25 November, 1983 (1), hereby make the following Regulations:

1. These Regulations may be cited as the European Communities (Names and Labelling of Textile Products) (Amendment) Regulations, 1985, and shall come into operation on the 28th day of November, 1985.

2. ( a ) A reference in these Regulations and in the European Communities (Names and Labelling of Textile Products) Regulations, 1973 ( S.I. No. 43 of 1973 ), to Council Directive No. 71/307/EEC of 26 July, 1971 (2), shall, save where the contrary intention appears, be deemed to be a reference to that Directive, as amended.

( b ) A word or expression that is used in the European Communities (Names and Labelling of Textile Products) Regulations, 1973, and in these regulations which is also used in Council Directive No. 71/307/EEC (2) shall, unless the contrary intention is expressed, have in those Regulations the same meaning that it has in that Directive.

3. The European Communities (Names and Labelling of Textile Products) Regulations, 1973, are hereby amended by—

( a ) the insertion in Regulation 2 after paragraph (2) of the following paragraphs—

"(3) The Minister, after consultation with the Institute for Industrial Research and Standards, and in accordance with the conditions contained in Article 6 (4) of Council Directive No. 71/307/EEC, may authorise tolerances in respect of particular products which are higher than those provided for in the said article 6 (4).

(4) Subject to the conditions contained in Article 8 (2) (c) of Council Directive No. 71/307/EEC, the labelling and marking required by that Article shall, when textile products are offered for sale or sold to the end consumer, be given in the Irish or the English language".

( b ) the substitution in Regulations 3 (1) and 6 for "£200" of "£800",

( c ) the substitution in Regulation 3 (2) for "this Regulation" of "these Regulations", and

( d ) the substitution in Regulation 5 (2) for "£100" of "£400".

4. (I) Nothing in these Regulations or in the European Communities (Names and Labelling of Textile Products) Regulations, 1973, shall operate so as to prevent the placing on the market of textile products which are in conformity with the provisions of Council Directive No. 71/307/EEC but which are not labelled in accordance with that Directive as amended by Council Directive No. 83/623/EEC.

(2) This Regulation shall cease to have effect on the 28 day of May, 1987.

EXPLANATORY NOTE.

These Regulations have been made to give effect to the European Council Directive No. 83/623/EEC of the 25th November, 1983 (OJ No. L353/8, 15 December 1983) which amends the Council Directive No. 71/307/EEC of 26 July, 1971 (OJ No. L 185/16, 25 August, 1971) (as adapted by the Treaty of Accession of Ireland to the Community) relating to the names and labelling of textile products.
