RESTRICTIVE PRACTICES (CINEMA FILMS) ORDER 1985.

I, JOHN BRUTON, Minister for Industry, Trade, Commerce and Tourism, having considered a report of the Restrictive Practices Commission of an enquiry under section 5 of the Restrictive Practices Act, 1972 (No. 11 of 1972) into the supply and distribution of cinema films, in exercise of the powers conferred on me by section 8 of that Act and by the Trade, Commerce and Tourism (Alteration of Name of Department and Title of Minister) Order, 1983 ( S.I. No. 384 of 1983 ), hereby order as follows:

1. This Order may be cited as the Restrictive Practices (Cinema Films) Order, 1985.

2. In this Order—

"designated exhibitor" means a person who, at the commencement of this Order, is carrying on the business of exhibiting films to the public in any cinema situated within a radius of one mile of the General Post Office, O'Connell Street, Dublin 1;

"exhibitor" means a person, other than a designated exhibitor, carrying on the business of exhibiting films to the public in any cinema situated in the county borough of Dublin or the county of Dublin;

"terms" means any terms relating to the timing of distribution or supply of cinema films for exhibiting to the public.

3. A person carrying on the business of distributing or supplying cinema films shall not, in the course of carrying on that business, accord less favourable terms to a designated exhibitor than the most favourable terms accorded by him to an exhibitor.

EXPLANATORY NOTE.

The purpose of this Order is to regulate the distribution of cinema films in Dublin City Centre.

The Act requires that the Order be confirmed by an Act of the Oireachtas before it will have the force of law.
