MERCHANT SHIPPING ACT, 1952 (SECTION 15) (AMENDMENT) ORDER, 1985.

I, JAMES MITCHELL, Minister for Communications, in exercise of the powers conferred on me by section 3 of the Merchant Shipping Act, 1981 (No. 33 of 1981),and the Ministers and Secretaries (Amendment) Act, 1983 (No. 40 of 1983), it appearing to me that, to give effect to the amendments to the Convention of 1974 ratified on the 29th day of November, 1983, it is necessary to amend section 15 of the Merchant Shipping (Safety Convention) Act, 1952 (No. 29 of 1952), in the manner herein contained, hereby make the following Order:

1. (1) This Order may be cited as the Merchant Shipping Act, 1952 (Section 15) (Amendment) Order, 1985.

2. Section 15 (4) of the Merchant Shipping (Safety Convention Act, 1952 (No. 29 of 1952), is hereby repealed.

EXPLANATORY NOTE.

The Order repeals sub- section 15 (4) of the Merchant Shipping (Safety Convention) Act, 1952 (No. 29 of 1952). (as substituted by section 12 of the Merchant Shipping Act, 1966 (No. 2 of 1966)). The repeal of this sub-section enables the Minister to give effect to the VHF Radiotelephony requirements of the International Convention for the Safety of Life at Sea, 1974 (SOLAS Convention) and the Amendments to that Convention which entered into force internationally on 1st September, 1984.

The VHF Radiotelephony requirements are given effect to in the Merchant Shipping (Radio Installations) (Amendment No. 2) Rules, 1985 ( S.I. No. 281 of 1985 ).
