EUROPEAN COMMUNITIES (DANGEROUS SUBSTANCES) (CLASSIFICATION, PACKAGING, LABELLING AND NOTIFICATION) (AMENDMENT) REGULATIONS, 1985.

I, RUAIRI QUINN, Minister for Labour, in exercise of the powers conferred on me by section 3 of the European Communities Act, 1972 (No. 27 of 1972), and for the purpose of giving effect to Council Directive 79/831/EEC1, hereby make the following Regulations:

1. These Regulations may be cited as the European Communities (Dangerous Substances) (Classification, Packaging, Labelling and Notification) (Amendment) Regulations, 1985.

2. In these Regulations "the Principal Regulations" means the European Communities (Dangerous Substances) (Classification, Packaging, Labelling and Notification) Regulations, 1982 ( S.I. No. 258 of 1982 ).

3. Regulation 5 (1) (a) of the Principal Regulations is hereby amended by the substitution of "the competent authority of one of the Member States in accordance with the Directive" for "the competent authority in accordance with these Regulations".

4. Regulations 6 to 9 (other than Regulation 9 (1)) of the Principal Regulations are hereby amended by the insertion after "the competent authority" of "referred to in Regulation 5 (1) (a) of these Regulations".

5. Regulation 9 (1) of the Principal Regulations is hereby amended by the substitution for "the competent authority" of "the competent authority referred to in Regulation 5 (1) (a) of these Regulations, the Commission and the authorities referred to in paragraph 6 of this Regulation".

EXPLANATORY NOTE.

These Regulations amend Regulations 5 (1) (a) and 6 to 9 of the European Communities (Dangerous Substances) (Classification, Packaging, Labelling and Notification) Regulations, 1982 ( S.I. No. 258 of 1982 ). Regulations 5(1) (a) and 6 (1) which require that substances shall not be placed on the market or imported unless they have been notified to the Irish competent authority are amended by these Regulations which require that notification should be sent to the competent authority of one of the Member States in accordance with the Directive. Consequential amendments have been made in regard to "competent authority" wherever else it is referred to in Regulations 6 to 9.

Regulation 9(1) which requires that certain information may be kept secret from all persons other than the Commission and the Irish competent authority is further amended by these Regulations which provide that the information may be kept secret from all persons other than the Commission and the competent authorities of the Member States.
