EUROPEAN COMMUNITIES (ALIENS) (AMENDMENT) REGULATIONS, 1985.

I, MICHAEL NOONAN, Minister for Justice, in exercise of the powers conferred on me by section 3 of the European Communities Act, 1972 (No. 27 of 1972), and for the purpose of giving effect to Council Directives 68/360/EEC1 and 73/148/EEC2, hereby make the following Regulations:

1. These Regulations may be cited as the European Communities (Aliens) (Amendment) Regulations, 1985.

2. In these Regulations "the Principal Regulations" means the European Communities (Aliens) Regulations, 1977 ( S.I. No. 393 of 1977 ).

3. The European Communities (Aliens) Regulations, 1977 and 1981, and these Regulations may be cited together as the European Communities (Aliens) Regulations, 1977 to 1985, and shall be construed together.

4. The Principal Regulations are hereby amended by the deletion of paragraph (6) of Regulation 7.

5. The Principal Regulations are hereby amended by the substitution of the following for paragraph (2) of Regulation 13:

"(2) Subject to Regulation 14, a seasonal worker while engaged on seasonal work in the State, or a person who while in employment in another member State has a residence in the State to which he normally returns at least once a week, shall have the right to reside in the State."

EXPLANATORY NOTE.

These Regulations amend the European Communities (Aliens Regulations 1977 ( S.I. No. 393 of 1977 ) to make certain minor alterations to the 1977 Regulations in relation to re-admission to the State and rights of residence.
