LAND PURCHASE ACTS RULES, 1984.

I, AUSTIN DEASY, Minister for Agriculture, in exercise of the powers conferred on me by section 3 of the Land Act, 1933 (No. 38 of 1933), as adapted by the Lands (Transfer of Departmental Administration and Ministerial Functions) Order, 1977 ( S.I. No. 28 of 1977 ), and the Agriculture and Fisheries (Alteration of Name of Department and Title of Minister) Order, 1977 ( S.I. No. 31 of 1977 ), and with the concurrence of a majority of the committee constituted pursuant to the provisions of the said section 3 and after consultation with the President of the Incorporated Law Society, hereby make the following Rules:

1. These Rules may be cited as the Land Purchase Acts Rules, 1984, and shall come into operation on the 1st day of December, 1984.

2. The Interpretation Act, 1937 (No. 38 of 1937) applies to these Rules.

3. In these Rules, "the Department" means the Department of Agriculture.

4. (1) The fee specified in column (3) of the Schedule to these Rules at any particular reference is hereby fixed as the fee for the service or services described in column (2) of the schedule at that reference.

(2) All fees payable pursuant to these Rules shall be lodged with the Department with the application for the service to which it relates.

(3) ( a ) Subject to paragraph (b) of this Rule, all payments made under this Rule shall be payable in cash, or by means of Land Commission stamps, banker's draft, money order, postal order or cheque drawn to the order of the Department.

( b ) Where an official of the Department is required to attend a court for the purpose of producing documents, the amount of any expenditure incurred by him in respect of travel and subsistence in connection with such attendance shall be paid by the person who requires such attendance.

5. Order IX of and paragraph II (entitled Schedule of Office Fees) of the Appendix to the Land Purchase Acts Rules of 1960 ( S.I. No. 20 of 1960 ), are hereby revoked.

EXPLANATORY NOTE.

These rules increase the fees payable for copies of title documents lodged with the Department of Agriculture. They also introduce charges for identification of lands the subject of an application for first registration of title and for marking on the ground the boundaries of turbary plots.
