EUROPEAN COMMUNITIES (SURVEILLANCE OF CERTAIN TEXTILE IMPORTS) REGULATIONS, 1984.

WHEREAS the State has been authorised under the Decision of the Commission of the European Communities dated the 20th day of December, 1979 (No. 80/47EEC 1), and by the Decision of that Commission dated the 25th day of January, 1984 (No. 84/61/EEC 2), to take the surveillance measures hereinafter specified (the conditions and details of which the Commission has determined in those Decisions):

NOW, I, JOHN BRUTON, Minister for Industry, Trade, Commerce and Tourism, in exercise of the powers conferred on me by section 3 of the European Communities Act, 1972 (No. 27 of 1972), hereby make the following Regulations:

1. These Regulations may be cited as the European Communities (Surveillance of Certain Textile Imports) Regulations, 1984.

2. (1) In these Regulations "the Minister" means the Minister for Industry, Trade, Commerce and Tourism.

(2) A reference in these Regulations to a Nimexe code shall be taken to be a reference to that code in the Annex to Council Regulation (EEC) No. 1445/723, as amended by Commission Regulation (EEC) No. 3589/834, and by any subsequent Regulations of an institution of the European Communities.

3. (1) These Regulations apply to the goods which are specified at a Nimexe code mentioned or referred to in column (1) of the Schedule to these Regulations, are in free circulation in any Member State of the Community and would be subject to quota or prohibition if importation into the State direct from the People's Republic of China were proposed.

(2) These Regulations shall cease to have effect on the 31st day of December, 1984.

(3) The particulars stated in column (2) of the Schedule to these Regulations are inserted solely to facilitate identification of the goods referred to at the Nimexe code mentioned or referred to in column (1) of that Schedule opposite the insertion in column (2), and, accordingly nothing contained in column (2) shall affect the construction or limit or control the operation of any provision of these Regulations (including the mention of, or reference to, the code in column (1)).

4. The importation into the State of any goods to which these Regulations apply shall be subject to the production by the importer of an import document issued by the Minister.

5. The European Communities (Surveillance of Certain Clothing and Textile Products Imports) Regulations, 1983 ( S.I. No. 417 of 1983 ), shall not apply to goods in free circulation to which these Regulations apply.

EXPLANATORY NOTE.

The effect of the Instrument is to enable the Minister for Industry, Trade, Commerce and Tourism to continue in operation a system of surveillance on imports of certain textile products originating in the People's Republic of China.
