S.I. No. 101/1984 - Garda Síochána (Appointments) Regulations, 1984.


I, MICHAEL NOONAN, Minister for Justice, in exercise of the powers conferred on my by section 14 of the Police Forces Amalgamation Act, 1925 (No. 7 of 1925), and section 1 of the Garda Síochána Act, 1958 (No. 14 of 1958), hereby, with the approval of the Government, make the following Regulations:—

1. (1) These Regulations may be cited as the Garda Síochána (Appointments) Regulations, 1984.

(2) The Garda Síochána (Appointments) Regulations, 1945 to 1982, and these Regulations may be cited together as the Garda Síochána (Appointments) Regulations, 1945 to 1984.

(3) These Regulations shall come into operation on the 17th day of April, 1984, and shall cease to have effect on the 30th day of June, 1984.

2. The Interpretation Act, 1937 (No. 38 of 1937), applies to these Regulations.

3. Nothwithstanding anything contained in the Garda Síochána (Appointments) Regulations, 1945 to 1982, the Minister for Justice, whenever the post of Surgeon of the Force or Surgeon of the Garda Síochána, as the case may be, is vacant, may direct that the medical examination for the purpose of certifying the matters specified in Article 4 (1) (b) (inserted by the Garda Síochána (Appointments) Regulations, 1981 ( S.I. No. 202 of 1981 )) of the Garda Síochána (Appointments) Regulations, 1945 (S.R. & O. No. 173 of 1945), and in Article 4 (1) (b) (as so inserted) of the Garda Síochána (Appointments) Regulations, 1958 ( S.I. No. 176 of 1958 ), in lieu of being carried out by the Surgeon of the Force or, as the case may be, the Surgeon of the Garda Síochána, be carried out, during such period as may be specified in the direction, by a registered medical practitioner (within the meaning of the Medical Practitioners Act, 1978 (No. 4 of 1978)) nominated by the Minister, and any medical practitioner, so nominated shall examine such persons and, if satisfied, certify the aforesaid matters, and a certificate so issued shall be sufficient to satisfy the requirements of Article 4(1) (b) of the said Garda Síochána (Appointments) Regulations, 1945, or the said Garda Síochána (Appointments) Regulations, 1958, as the case may be.

EXPLANATORY NOTE.

These Regulations provide for the nomination by the Minister for Justice of registered medical practitioners to examine and to certify candidates for recruitment to the Garda Síochána.
