LOCAL GOVERNMENT (OFFICERS) REGULATIONS, 1984.

The Minister for the Environment in exercise of the powers conferred on him by section 19 of the Local Government Act, 1941 (No. 23 of 1941) as amended by section 14 of the Local Government Act, 1955 (No. 9 of 1955) hereby makes the following Regulations:

1. These Regulations may be cited as the Local Government (Officers) Regulations, 1984.

2. These Regulations and the Local Government (Officers) Regulations, 1943 to 1983 shall be construed together and may be cited as the Local Government (Officers) Regulations, 1943 to 1984.

3. These Regulations shall come into operation on the 1st day of April, 1984.

4. In these Regulations—

"local authority" has the same meaning as in Part II of the Local Government Act, 1941 .

"office" means any office within the meaning of Part II of the Local Government Act, 1941 in respect of which the Minister for the Environment is the appropriate Minister.

5. (1) The holder of an office under a local authority shall not engage in any gainful occupation, other than as an officer of the local authority, to such an extent as to impair the performance of his duties as an officer of the local authority or in any occupation which might conflict with the interests of the local authority or which might be inconsistent with the discharge of his duties as a local authority officer.

(2) Without prejudice to the generality of sub-article (1) of this article the holder of a whole-time office, the qualifications for which are wholly or in part professional, shall not engage in private practice in the profession in which he is employed by the local authority or local authorities or in any cognate profession.

EXPLANATORY NOTE.

These Regulations contain provisions restricting the engagement, otherwise than for a local authority, in gainful occupations and private practice in the case of officers of local authorities for whom the Minister for the Environment is the appropriate Minister under the Local Government Acts.
