EUROPEAN COMMUNITIES (IMPOSITION OF ANTI-DUMPING DUTY ON CERTAIN IRON AND STEEL PRODUCTS) (No. 2) REGULATIONS, 1983.

I, FRANK CLUSKEY, Minister for Trade, Commerce and Tourism, in exercise of the powers conferred on me by section 3 of the European Communities Act, 1972 (No. 27 of 1972), and for the purpose of giving effect to Commission Recommendation No. 1230/83/ECSC of the 18th day of May, 1983,1 hereby make the following regulations:

1. (1) These Regulations may be cited as the European Communities (Anti-Dumping Duty on Certain Iron and Steel Products) (No. 2) Regulations, 1983.

(2) This Order shall be deemed to have come into operation on the 21st day of May, 1983.

2. A word or expression that is used in these Regulations and is also used in Commission Recommendation No. 1230/83/ECSC of the 18th May, 1983, shall, unless the contrary intention appears, have in these Regulations the same meaning as it has in that Recommendation.

3. (1) An anti-dumping duty at the rate specified in paragraph (2) of this Regulation shall be charged, levied and paid on goods which are imported into the State and are of the following description, that is to say, sheets and plates of iron or steel, not further worked than hot-rolled, of a thickness of 3mm or more, which are classified at tariff sub-heading number 73.13 B1 ex a of the Common Customs Tariff and corresponding to NIMEXE Codes 73.13-17, 19, 21 and 23, and which originate in Brazil, other than goods of that description which originate in Brazil and are imported into the State from another Member State of the European Communities and in respect of which an anti-Dumping duty has been charged in accordance with Commission Recommendation No. 1230/83/ECSC.

(2) Subject to Regulation 4 of these Regulations the duty imposed by these Regulations shall be at a rate of 72.20 ECU per 1,000 kilograms net.

4. In any case where the importer of the goods is able to establish to the satisfaction of the Revenue Commissioners that the quality of the goods is inferior to the lowest quality described in the last Commission publication concerning basic prices of iron and steel products, the duty shall be reduced accordingly.

5. The European Communities (Imposition of Provisional Anti-D umping Duty on Certain Iron and Steel Goods) Regulations, 1983, are hereby revoked.

6. For the purpose of these Regulations, the country of origin of goods shall be determined in accordance with the rules of origin contained in Council Regulation EEC No. 802/682 of the 27th day of June, 1968, as amended.

7. The duty imposed by these Regulations is hereby placed under the care and management of the Revenue Commissioners.

EXPLANATORY NOTE.

These Regulations provide for the imposition of a definitive anti-dumping duty on imports of certain iron and steel goods, as described in paragraph 3, originating in Brazil. Except as provided in paragraph 4, the duty shall be at a rate of 72.20 ECU per 1,000 kilograms net.
