EUROPEAN COMMUNITIES (BROADCASTING AUTHORITY ACT, 1960) REGULATIONS, 1983.

I, JIM MITCHELL, Minister for Posts and Telegraphs, in exercise of the powers conferred on me by Section 3 of the European Communities Act, 1972 (No. 27 of 1972), to give effect to the EEC Treaty within the meaning of Section 1 (1) of that Act, in so far as it relates to Section 20 of the Broadcasting Authority Act, 1960 (No. 10 of 1960), hereby make the following regulations:

1. These Regulations may be cited as the European Communities ( Broadcasting Authority Act, 1960 ) Regulations, 1983.

2. Section 20 (5) of the Broadcasting Authority Act, 1960 (No. 10 of 1960), is hereby repealed.

EXPLANATORY NOTE.

These Regulations are made to give effect to Commission Directive 70/50/EEC on the abolition of measures which have an effect equivalent to quantitative restrictions on imports and are not covered by other provisions adopted in pursuance of the EEC Treaty. The Regulations repeal sub-section (5) of section 20 of the Broadcasting Authority Act, 1960 which obliged the Radio Telefís Éireann Authority to have regard to the special position of "Irish advertisers" (as defined in the said subsection) and empowered it to fix reduced charges and preferential conditions for advertisements from them which were "Irish advertisements" (as defined in the said subsection).
