DETENTION OF OFFENDERS (LOUGHAN HOUSE) (AMENDMENT) REGULATIONS, 1983.

I, MICHAEL NOONAN, Minister for Justice, in exercise of the powers conferred on me by section 3 of the Prisons Act, 1970 (No. 11 of 1970), hereby made the following Regulations:—

1. (1) These Regulations may be cited as the Detention of Offenders (Loughan House) (Amendment) Regulations, 1983.

(2) The Detention of Offenders (Loughan House) Regulations, 1973 ( S.I. No. 60 of 1973 ), and these Regulations may be cited together as the Detention of Offenders (Loughan House) Regulations, 1973 and 1983, and shall be construed together as one.

2. The Detention of Offenders (Loughan House) Regulations, 1973 ( S.I. No. 60 of 1973 ), are hereby amended by the substitution for Regulation 3 of the following Regulation:

"3. Male persons who, at the time of their transfer to Loughan House, are not less than 18 years of age may be detained therein.".

3. (1) Notwithstanding any provision of the Rules for the Government of Prisons, 1947 (S. R. & O., No. 320 of 1947) (as adapted to Loughan House by Regulation 10 of the Saint Patrick's Institution Regulations, 1960 ( S.I. No. 224 of 1960 ), and Regulation 7 of the Detention of Offenders (Loughan House) Regulations, 1973 ( S.I. No. 60 of 1973 )), where the Governor is of the opinion that accommodation in Loughan House is insufficient to enable each offender to occupy a room by himself, the Governor may give a direction enabling, for so long as the said accommodation continues to be insufficient, two or more offenders to occupy a room and such direction may apply to offenders generally or offenders of a particular class.

(2) Where a direction under these Regulations is for the time being in force and in the opinion of the Governor the insufficiency of accommodation which caused the direction to be made no longer exists he shall revoke the direction.

EXPLANATORY NOTE.

These Regulations specify that male persons of not less than 18 years may be detained in Loughan House and provide that the Governor of the House may, in certain circumstances, give a direction enabling two or more offenders to occupy a room and that the Governor may revoke such a direction.
