ROAD TRAFFIC ACT, 1961 (SECTION 103) (OFFENCES) (AMENDMENT) REGULATIONS, 1983.

The Minister for the Environment in exercise of the powers conferred on him by sections 5 and 103 of the Road Traffic Act, 1961 (No. 24 of 1961) as amended by sections 6 and 64 of the Road Traffic Act, 1968 (No. 25 of 1968) and section 74 of the Finance Act, 1976 (No. 16 of 1976) hereby makes the following Regulations:—

1. (1) These Regulations may be cited as the Road Traffic Act, 1961 , (Section 103) (Offences) (Amendment) Regulations, 1983.

(2) The Principal Regulations, the 1979 Regulations and these Regulations shall be construed as one and may be collectively cited as the Road Traffic Act, 1961 (Section 103) (Offences) Regulations, 1976 to 1983.

2. In these Regulations:—

"the Principal Regulations" means the Road Traffic Act, 1961 (Section 103) (Offences) Regulations, 1976 ( S.I. No. 188 of 1976 );

"the 1979 Regulations" means the Road Traffic Act, 1961 (Section 103) (Offences) (Amendment) Regulations, 1979 ( S.I. No. 167 of 1979 );

"the Dublin area" means the area consisting of the county borough of Dublin, the borough of Dún Laoghaire and the county health district of Dublin.

3. The following article is hereby substituted for article 5 of the Principal Regulations as amended by Article 4 (1) of the 1979 Regulations—

"5. The prescribed amounts for the purposes of paragraph (b) of subsection (2) and of paragraph (b) of subsection (3) of section 103 of the Act for offences declared by the Minister to be offences to which that section applies shall be—

( a ) ten pounds in respect of the offence of stopping or parking during a clearway period on a part of a roadway which is a clearway in contravention of a bye-law or rule under section 89 or section 90 of the Act (as amended by section 6 of the Road Traffic Act, 1968 ) where the said bye-law or rule applies to any part of the Dublin area,

( b ) seven pounds in respect of the offence of stopping or parking during a clearway period on a part of a roadway which is a clearway in contravention of a bye-law or rule under section 89 or section 90 of the Act (as amended by section 6 of the Road Traffic Act, 1968 ) where the said bye-law or rule applies to an area not being part of the Dublin area,

( c ) ten pounds in respect of the offence of parking on a part of a roadway which is a bus lane in contravention of a bye-law or rule under section 90 of the Act (as amended by section 6 of the Road Traffic Act, 1968 ) where the said bye-law or rule applies to any part of the Dublin area, and

( d ) five pounds in respect of all other offences."

4. The First Schedule to the Principal Regulations as amended by Article 4 (2) of the 1979 Regulations is hereby amended by the substitution of the words "ten pounds, seven pounds or five pounds" for the words "seven pounds or five pounds" in each case where they occur in the said Schedule.

5. These Regulations shall come into force on the 1st day of May, 1983.

EXPLANATORY NOTE.

These Regulations amend the Road Traffic Act, 1961 (Section 103) (Offences) Regulations, 1976 and the Road Traffic Act, 1961 (Section 103) (Offences) (Amendment) regulations, 1979 by prescribing £10 as the amount in respect of a clearway offence in the Dublin area which a person liable to prosecution for an offence to which section 103 of the Act applies may pay as an alternative to the institution of a prosecution. The Regulations also prescribe £10 in respect of the offence of parking on a bus lane in the Dublin area as the amount which a person liable to prosecution may pay as an alternative to the institution of a prosecution.
