AN ACT TO AMEND THE PREVENTION OF ELECTORAL ABUSES ACT, 1923 . [19th May, 1982] |
||||||||

BE IT ENACTED BY THE OIREACHTAS AS FOLLOWS: |
||||||||

Amendment of Prevention of Electoral Abuses Act, 1923. |
1.—The Prevention of Electoral Abuses Act, 1923 , is hereby amended by the substitution of the following section for section 3: |

“Definition of personation. |
||||||||
|
3.—A person who— |
||||||||
|
(a) at an election applies for a ballot paper in the name of some other person, whether that name be the name of a living person or of a dead person or of a fictitious person, or |
||||||||
|
(b) having obtained a ballot paper once at an election applies at the same election for a ballot paper in his own name (otherwise than under Rule 26 of Part I of the Fifth Schedule to the Electoral Act, 1923 ), |
||||||||
|
shall be guilty of the offence of personation.”. |

Short title. |
2.—This Act may be cited as the Prevention of Electoral Abuses Act, 1982. |
