S.I. No. 443/1981 - Harbour Rates (Wicklow Harbour) (No. 2) Order, 1981


I, PATRICK COONEY, Minister for Transport, in exercise of the powers conferred on me by section 104 of the Harbours Act, 1946 (No. 9 of 1946), the Transport, Fuel and Power (Transfer of Departmental Administration and Ministerial Functions) Order, 1959 ( S.I. No. 125 of 1959 ), and the Tourism and Transport (Alteration of Name of Department and Title of Minister) Order, 1980 ( S.I. No. 11 of 1980 ), and after due compliance with section 106 of that Act, hereby order as follows:—

1. (1) This Order may be cited as the Harbour Rates (Wicklow Harbour) (No. 2) Order, 1981.

(2) This Order shall come into operation on the 1st day of January, 1982.

2. (1) The Harbour Rates (Wicklow Harbour) Order, 1949 ( S.I. No. 172 of 1949 ), is hereby amended by—

(a) the substitution for the First Schedule (inserted by the Harbour Rates (Wicklow Harbour) Order, 1981 ( S.I. No. 54 of 1981 )), thereto of the following:

“SECOND SCHEDULE

Maximum Tonnage Rates

On every ton of the net register tonnage or half the gross tonnage, whichever is the greater, of every vessel entering the harbour:

Rates on fishing vessels:

(a)

As a composition in full in lieu of tonnage rates on every fishing vessel entering the harbour for the purpose of landing fish, per year:

(b)

On every fishing vessel entering the harbour for any purpose other than landing fish, for each entry:

£3.40

The rate at 2 (b) is chargeable for each stay in the harbour of seven days or part thereof.

3.

Rates on Pleasure Boats:

(a)

On every open pleasure boat of 1 ton gross or under as a composition in full in lieu of tonnage rates payable yearly in advance, a sum not exceeding:

£3.60

(b)

On every decked or part decked pleasure boat of 1½ tons gross or under as a composition in full in lieu of tonnage rates payable half yearly in advance, for the period

(i) 1st April-30th September, a sum not exceeding

£20.00

(ii) 1st October-31 March, a sum not exceeding

£20.00

(c)

On every decked or part decked pleasure boat of 10 tons gross or under but over 1½ tons gross as a comp- osition in full in lieu of tonnage rates payable half yearly in advance, for the period

(i) 1st April-30th September, a sum not exceeding

£20.00

(ii) 1st October-31 March, a sum not exceeding

£20.00

(d)

On every decked or part decked pleasure boat over 10 tons gross as a composition in full in lieu of tonnage rates payable half yearly in advance, for the period

(i) 1st April-30th September, a sum not exceeding

(e)

On all pleasure boats entering the harbour and not paying the composition rates at reference number 3(a) (b), (c) or (d) above and remaining in the harbour less than seven days:

for vessels remaining in the harbour between seven and 14 days a further:

for vessels remaining in the harbour between 14 and 21 days a further:

£10.80

and for every 7 days or part thereof over 21 days a further:

(2) Where rates fixed under this Order are payable at a metric tonne charge, lesser weights shall be chargeable as follows:

(a) any weight not exceeding 250 kilogrammes shall count as 250 kilogrammes,

(b) any weight exceeding 250 kilogrammes but not exceeding 500 kilogrammes shall count as 500 kilogrammes,

(c) any weight exceeding 500 kilogrammes but not exceeding 750 kilogrammes shall count as 750 kilogrammes,

(d) any weight exceeding 750 kilogrammes but not exceeding one tonne shall count as one tonne.

3. The Harbour Rates (Wicklow Harbour) Order, 1981, is hereby revoked.
