S.I. No. 386/1981 - Members of the Oireachtas and Ministerial and Parliamentary Offices (Allowances and Salaries) Order, 1981.


The Government, in exercise of the powers conferred on them by section 3A of the Oireachtas (Allowances to Members) Act, 1938 (No. 34 of 1938) (inserted by section 5 of the Oireachtas (Allowances to Members) and Ministerial and Parliamentary Offices (Amendment) Act, 1973 (No. 22 of 1973)), as amended by section 4 of the Oireachtas (Allowances to Members) and Ministerial, Parliamentary and Judicial Offices (Amendment) Act, 1977 (No. 29 of 1977), and section 8A of the Ministerial and Parliamentary Offices Act, 1938 (No. 38 of 1938) (inserted by section 11 of the Oireachtas (Allowance to Members) and Ministerial and Parliamentary Offices (Amendment) Act, 1973 (No. 22 of 1973)), as amended by section 7 of the Oireachtas (Allowances to Members) and Ministerial, Parliamentary and Judicial Offices (Amendment) Act, 1977 , hereby make the following Order:

1. This Order may be cited as the Members of the Oireachtas and Ministerial and Parliamentary Offices (Allowances and Salaries) Order, 1981.

2. In this Order—

“the Act of 1938” means the Ministerial and Parliamentary Offices Act, 1938 (No. 38 of 1938);

“the Act of 1973” means the Oireachtas (Allowances to Members) and Ministerial and Parliamentary Offices (Amendment) Act, 1973 (No. 22 of 1973).

3. The allowance payable monthly under section 3 of the Oireachtas (Allowances to Members) Act, 1938 (No. 34 of 1938), as amended by section 4 of the Act of 1973, to each member of Dáil éireann shall, with effect from the 1st day of June, 1981, be and be deemed to have been £13,802 per annum and the allowance payable to each member of Seanad éireann shall, with effect from the said 1st day of June, be and be deemed to have been £7,619 per annum.

4. The annual sum payable by way of salary under subsection (1) of section 3 of the Act of 1938 (inserted by section 7 of the Act of 1973) or subsection (2) of the said section 3 (inserted by section 6 of the Oireachtas (Allowances to Members) and Ministerial, Parliamentary and Judicial Offices (Amendment) Act, 1977 (No. 29 of 1977)), shall, with effect from the 1st day of June, 1981, be and be deemed to have been a sum not exceeding—

(a) in the case of the Taoiseach, £23,493,

(b) in the case of the Tánaiste, £17,310,

(c) in the case of a member of the Government, other than the Taoiseach or the Tánaiste, £15,456,

(d) in the case of a Minister of State appointed under section 1 of the Ministers and Secretaries (Amendment) (No. 2) Act, 1977 (No. 28 of 1977) £8,655.

5. The annual sum payable by way of salary under section 4 of the Act of 1938 (inserted by section 8 of the Act of 1973) to the Attorney General shall, with effect from the 1st day of June, 1981, be and be deemed to have been a sum not exceeding—

(a) in case the person who holds the office is not a member of either House of the Oireachtas, £24,930,

(b) in case a member of either House of the Oireachtas holds the office, £15,456.

6.(a) The annual sum payable by way of salary under section 5 (1) of the Act of 1938 (inserted by section 9 of the Act of 1973) to the Chairman of Dáil éireann shall, with effect from the 1st day of June, 1981, be and be deemed to have been a sum not exceeding £15,456, and the annual sum so payable under the said section 5 (1) to the Deputy Chairman of Dáil éireann shall, with effect from the said 1st day of June, be and be deemed to have been a sum not exceeding £8,655, and

(b)  the annual sum payable by way of salary under section 6 (1) of the Act of 1938 (inserted by section 10 of the Act of 1973) to the Chairman of Seanad éireann shall, with effect from the said 1st day of June, be and be deemed to have been a sum not exceeding £6,492, and the annual sum payable under the said section 6 (1) to the Deputy Chairman of Seanad éireann shall, with effect from the said 1st day of June, be and be deemed to have been a sum not exceeding £3,710.

7. The annual sums payable under section 9A (inserted by section 13 of the Act of 1973) and section 10 (as amended by section 14 of the Act of 1973) of the Act of 1938 by way of allowance for expenses, shall, with effect from the 1st day of June, 1981, be and be deemed to have been—

(i)  in the case of the sum payable under subsection (1) of the said section 9A, £59,191,

(ii)  in the case of the sum payable under paragraph (a) of subsection (2) of the said section 9A, £41,434,

(iii)  in the case of the sum payable under paragraph (b) of subsection (2) of the said section 9A, £17,757,

(iv)  in the case of the sum payable under paragraph (a) of subsection (3) of the said section 9A, £29,596,

(v)  in the case of the sum payable under paragraph (b) of the said subsection (3), £29,596, divided in the manner specified in that paragraph,

(vi)  in the case of the sum payable under subsection (1) of the said section 10, £147,977,

(vii) in the case of the sum payable under paragraph (a) of subsection (2) of the said section 10, £117,522,

(viii) in the case of the sum payable under paragraph (b) of the last-mentioned subsection (2), £58,331,

(ix) in the case of the sum payable under paragraph (a) of subsection (3) of the said section 10, £73,989, and

(x) in the case of the sum payable under paragraph (b) of the last-mentioned sub-section (3), £73,989, divided in the manner specified in that paragraph.

8. Articles 3 to 6 of this Order provide for increases calculated in accordance with the provisions of Clause 3.1 excluding the second and fourth subparagraphs) of Part 2 of the Second National Understanding for Economic and Social Development dated October, 1980.
