S.I. No. 345/1981 - European Communities (New Wooden Furniture) Regulations, 1981.


I, JOHN KELLY, Minister for Trade, Commerce and Tourism, in exercise of the powers conferred on me by section 3 of the European Communities Act, 1972 (No. 27 of 1972), and for the purpose of giving effect to Articles 30 and 34 of the Treaty establishing the European Economic Community, hereby make the following regulations:

1. These Regulations may be cited as the European Communities (New Wooden Furniture) Regulations, 1981.

2. These Regulations shall come into operation on the 11th day of October, 1981.

3. The Merchandise Marks (Restriction on Importation of New Wooden Furniture) Order, 1935 ( S.R. & O., No. 401 of 1935 ), shall not apply to new wooden furniture which is imported into the State and which originates either in a Member State of the European Communities or in a state with which the European Communities has an agreement in which there are provisions which require the abolition of measures of equivalent effect to quantitative restrictions on the importation into the State of new wooden furniture.

4. For the purpose of these Regulations, the country of origin of goods shall be determined in accordance with the rules of origin contained in Council Regulation EEC No. 802/681 of the 27th day of June, 1968 (as amended).

EXPLANATORY NOTE.

(This note is not part of the instrument and does not purport to be a legal interpretation.)

These Regulations are made to give effect to Articles 30 and 34 of the EEC Treaty by revoking the requirement in the Merchandise Marks (Restriction on Importation of New Wooden Furniture) Order, 1935 ( S.R. & O., No. 401 of 1935 ) that furniture of the kind referred to in the Order which is imported from an EEC member state or from a country with which the EEC has a relevant association agreement, bear an indication of origin.
