S.I. No. 267/1981 - Health Services Regulations, 1981.


The Minister for Health, in exercise of the powers conferred on her by section 5 of the Health Act, 1947 (No. 28 1947) and sections 59 and 72 of the Health Act, 1970 (No. 1 of 1970) hereby makes the following Regulations:

1. These Regulations may be cited as the Health Services Regulations, 1981.

2. These Regulations shall come into operation on 1st day of August, 1981.

3. The Health Services Regulations, 1980 ( S.I. No. 61 of 1980 ) are hereby revoked.

4. There shall be substituted for article 6 of the Health Services Regulations, 1972, ( S.I. No. 88 of 1972 ) the following article:—

“6 (1) The period determined for the purposes of section 59 (2) of the Act shall be the period commencing on the first day of any month and ending on the last day of that month and the amount determined for the purposes of that sub-section shall be £12.

(2) Where the balance of the cost of a person being supplied in respect of the relevant period with drugs, medicines and medical and surgical appliances exceeds £12 the amount met by the health board shall be the amount by which the balance exceeds £12.

(3) Any function relating to a health board as respects an arrangement under this article shall be a function of the Chief Executive Officer of the Board.”

EXPLANATORY NOTE.

These Regulations replace article 6 of the Health Services Regulations, 1972 and revoke the Health Services Regulations, 1980.

In respect of expenditure incurred after 1st August, 1981 on prescribed drugs, medicines and medical and surgical appliances, the Regulations provide for the refund of the amount by which such expenditure exceeds £12 in any month.
