CORAS IOMPAIR EIREANN, SALARIED OFFICERS' AND CLERKS' (G.S.R.) SUPERANNUATION SCHEME (AMENDMENT) SCHEME, 1981 CONFIRMATION ORDER, 1981.

I, ALBERT REYNOLDS, Minister for Transport, in exercise of the powers conferred on me by Rule 54 (2) of the Coras Iompair Eireann, Salaried Officers' and Clerks' (GSR) Superannuation Scheme, the Transport, Fuel and Power (Transfer of Departmental Administration and Ministerial Functions) Order, 1959 ( S.I. No. 125 of 1959 ), and the Tourism and Transport (Alteration of Name of Department and Title of Minister) Order, 1980 ( S.I. No. 11 of 1980 ), and by virtue of the operation of section 45 of the Transport Act, 1950 (No. 12 of 1950), hereby order as follows:

1. This Order may be cited as the Coras Iompair Eireann Salaried Officers' and Clerks' (GSR) Superannuation Scheme (Amendment) Scheme, 1981 (Confirmation) Order, 1981.

2. The amending scheme submitted by the Board under Rule 45 (1) of the said Coras Iompair Eireann, Salaried Officers' and Clerks' (GSR) Superannuation Scheme, as modified by the Minister for Transport (a copy whereof, as so modified, is set out in the Schedule to this Order), is hereby confirmed, and shall be deemed to have come into operation on the first day of March, 1981, and shall expire on the last day of February, 1982.

SCHEDULE

CORAS IOMPAIR EIREANN, SALARIED OFFICERS' AND CLERKS' (G.S.R.) SUPERANNUATION SCHEME (AMENDMENT) SCHEME, 1981

1. Interpretation:

In this amending Scheme the following words and expressions shall have the meanings hereby assigned to them unless there is something inconsistent in the subject matter or the context repugnant to such construction:—

"The existing Scheme" means the Coras Iompair Eireann Salaried Officers' and Clerks' (GSR) Superannuation Scheme as scheduled to the Great Southern Railways Company (Superannuation Scheme) Act, 1947 (No. 21 of 1947) as amended by the subsequent Amending Schemes confirmed by Statutory Instrument No. 220 of 1963 and No. 76 of 1971 and No. 253 of 1974 and No. 46 of 1977.

"The operative date" means the 1st day of March, 1981.

2. In this amending Scheme unless otherwise expressly stated words and expressions used shall have the meanings assigned to them by the existing Scheme.

3. Amendment of the Existing Scheme:

The following new Clause shall be inserted in the existing Scheme to follow Clause (3) of Rule 14 with effect from the operative date:—

"14 (3) (a). A member having 10 years pensionable membership whose services are dispensed with on or after the operative date and before the 1st day of March, 1982 because of redundancy arising from any scheme for the re-organisation or more economical operation of any department of the Board's undertaking, he or she then being between the age of 55 years and 60 years (or between the ages of 50 years and 55 years in the case of a female member who has not opted for a normal retiring age of 60 to 65 years) may, if the Board so agrees, be granted the superannuation allowance provided for under Clause (1) of this Rule.

(b) If an additional contribution to the Fund is required to meet the cost of providing a superannuation allowance under paragraph (a) above, it shall be contributed by the member or by the Board or jointly by the member and the Board as they may agree between them.

EXPLANATORY NOTE

The purpose of the scheme is to provide for the reduction, under certain conditions, of the retiring ages prescribed in the existing scheme, to allow for voluntary early retirement on redundancy.
