WATERFORD APPOINTED STANDS (STREET SERVICE VEHICLES) BYE-LAWS, 1979.

I, PATRICK McLAUGHLIN, Commissioner of the Garda Síochána, in exercise of the powers conferred on me by section 84 (as amended by section 6 of the Road Traffic Act, 1968 (No. 25 of 1968) ) of the Road Traffic Act, 1961 (No. 24 of 1961), and after consultation with the Mayor, Alderman and Burgesses of Waterford, hereby make the following bye-laws in respect of the area comprising the county borough of Waterford:

1 Short title.

1. These bye-laws may be cited as the Waterford Appointed Stands (Street Service Vehicles) Bye-Laws, 1979.

2 Interpretation.

2. In these bye-laws "street" means a public road.

3 Appointment of appointed stand.

3. In the street mentioned in column (2) of the Schedule to these bye-laws, the part of that street described in column (3) of that Schedule opposite the mention in column (2) of that street shall be an appointed stand available, subject to these bye-laws, for use without limitation as to time or occasion.

4 Position of vehicles on appointed stand.

4. (1) For the purpose of these bye-laws, a street service vehicle shall be taken not to be standing for hire on an appointed stand unless the whole of the vehicle is within the limits of the appointed stand as specified in column (3) of the Schedule to these bye-laws.

(2) Every street service vehicle standing for hire on the appointed stand referred to in bye-law 3 of these bye-laws shall be placed in a single line with the rere of the vehicle to the kerb and facing northwards, and a street service vehicle shall be taken for the purpose of these bye-laws not to be standing for hire on that appointed stand unless it is in that position.

(3) A street service vehicle standing for hire on the appointed stand referred to in bye-law 3 of these bye-laws shall not be placed more than 18 inches from the kerb.

5 Maximum number of street service vehicles at appointed stand.

5. Whenever 12 street service vehicles are standing for hire on the appointed stand referred to in bye-law 3 of these bye-laws, the driver of any street service vehicle not already so standing for hire shall not place that vehicle on that appointed stand.

6 General provisions relating to appointed stands.

6. (1) The following provisions apply in respect of street service vehicles standing for hire on the appointed stand referred to in bye-law 3 of these bye-laws:

(a) a street service vehicle shall not be so placed on that appointed stand that it rests wholly or partly on a footway, or that portion of the vehicle projects over the footway so as to interfere with the free movement of pedestrians on the footway;

(b) a person shall not wash, overhaul or execute repairs to such a street service vehicle, except such repairs as are necessary to enable the vehicle to be removed from the appointed stand;

(c) neither the driver of such a street service vehicle nor any other person shall make any unnecessary noise by means of or in relation to the vehicle or the engine or any equipment, fittings or instruments fitted to or carried on the vehicle or any loudspeaker in or on or in any way connected with the vehicle.

(2) The driver of a street service vehicle which is placed on, being brought into or removed from the appointed stand referred to in bye-law 3 of these bye-laws shall comply with all directions given to him by a member of the Garda Síochána in relation to the placing of the vehicle on the appointed stand or the bringing of the vehicle into, or the removal of the vehicle from, the appointed stand.

7 General restrictions on street service vehicles standing for hire.

7. A driver of a street service vehicle shall not stand it for hire in the county borough of Waterford otherwise than on the appointed stand referred to in bye-law 3 of these bye-laws and in accordance with these bye-laws.

On the northern side of the original south boundary wall of the pre-1978 Terminus Street from a point 55 feet 1½inches (16.8 metres) west of the line of the western parapet of Redmond Bridge westwards for a further distance of 98 feet 5 inches (30 metres).

EXPLANATORY NOTE.

These bye-laws:

(1) provide a stand for street service vehicles as indicated in the Schedule to these bye-laws,

(2) outline the conditions subject to which street service vehicles may lawfully use that stand, and

(3) prohibit the driver of a street service vehicle from standing the vehicle for hire elsewhere than on the appointed stand.
