DUBLIN TRAFFIC AND PARKING (No. 2) BYE-LAWS, 1980.

I, PATRICK McLAUGHLIN, Commissioner of the Garda Siochana, in exercise of the powers conferred on me by sections 89 and 90 (as amended by section 6 of the Road Traffic Act, 1968 (No. 25 of 1968) ) of the Road Traffic Act, 1961 (No. 24 of 1961), with the consent of the Minister for the Environment and after consultation with the Right Honourable the Lord Mayor, Aldermen and Burgesses of Dublin, the council of the county of Dublin, the corporation of Dun Laoghaire and the commissioners of the town of Balbriggan, hereby make the following bye-laws in respect of the area comprising the county borough of Dublin, the borough of Dun Laoghaire, the county of Dublin and the town of Balbriggan:

1. These bye-laws may be cited as the Dublin Traffic and Parking (No. 2) Bye-Laws, 1980.

2. In these bye-laws—

"the principal bye-laws" means the Dublin Traffic and Parking Bye-Laws, 1976 ( S.I. No. 83 of 1976 );

"the bus lane regulations" means the Road Traffic (Signs) (Bus Lane) Regulations, 1980 ( S.I. No. 358 of 1980 ).

3. Bye-Law 2(1) of the principal bye-laws is hereby amended by the substitution of the following definitions for those of "bus lane" and "contra-flow bus lane":

"'with-flow bus lane' means a portion of a street at each entrance to which the roadway markings referred to in article 4 of the bus lane regulations and sign A or B referred to in the Second Schedule of the bus lane regulations are provided;

'contra-flow bus lane' means a portion of a street at each entrance to which the roadway markings referred to in article 4 of the bus lane regulations and sign C referred to in the Second Schedule of the bus lane regulations are provided:

'bus-only street' means a street or portion of a street at each entrance to which traffic sign 216 authorised by the Road Traffic (Signs) Regulations, 1962 ( S.I. No. 171 of 1962 ), as amended, together with an information plate or plates so authorised and specifying the class of vehicles to which the prohibition indicated by the traffic sign does not apply, are provided;

'access' means access by vehicles to premises accessible only from a bus-only street and includes stopping a vehicle on such a street solely for the purpose of loading or unloading goods on to or from the vehicle from or to those premises.".

4. Part VII of the principal bye-laws (inserted by the Dublin Traffic and Parking Bye-Laws, 1980 ( S.I. No. 82 of 1980 )) is hereby amended by the substitution of the following bye-laws for bye-laws 23 and 24:

"23. (1) A person shall not enter a with-flow bus lane with a vehicle other than an omnibus or a pedal cycle.

(2) A person shall not enter a contra-flow bus lane with a vehicle other than an omnibus.

(3) A person shall not enter a bus-only street with a vehicle other than an omnibus except for the purpose of access.

24. A person shall not park a vehicle in a with-flow bus lane or a contra-flow bus lane except where a traffic sign indicates that parking is permitted, and in such a case in accordance with the traffic sign.".

EXPLANATORY NOTE.

These bye-laws amend Part VII (inserted by the Dublin Traffic and Parking Bye-Laws, 1980 ( S.I. No. 82 of 1980 )) of the Dublin Traffic and Parking Bye-Laws, 1976 ( S.I. No. 83 of 1976 ) to distinguish bus lanes and bus-only streets and the restriction on traffic entering or parking on these bus lanes or bus-only streets.
