THE ADELAIDE HOSPITAL (CHARTER AMENDMENT) ORDER, 1980.

The Minister for Health, on the application of the governing body of the Adelaide Hospital and in exercise of the powers conferred on him by section 76 of the Health Act, 1970 (No. 1 of 1970) after consultation with the Commissioners of Charitable Donations and Bequests for Ireland, hereby orders as follows:—

1. This Order may be cited as the Adelaide Hospital (Charter Amendment) Order, 1980.

2. In this Order "the Charter" means the Letters Patent of the 27th day of November, 1920, granting incorporation to the Adelaide Hospital, Dublin.

3. The Charter is hereby amended as follows:—

( a ) In clause (1) the word "Ireland" shall be substituted for the words "Our United Kingdom of Great Britain and Ireland" and the words "Ireland or elsewhere" for the words "Our United Kingdom";

( b ) In clause (2) the words "within Our United Kingdom of Great Britain and Ireland" shall be deleted.

( c ) In clause (5) (e) the words "and that no person shall at any time be eligible to hold any appointment in connection therewith, or to vote or take any part in any of its proceedings, or except in cases of emergency, be permitted access to the Hospital to communicate Religious Instruction, or for any purpose of Religion whatever who is not a member of or does not profess the doctrine of the Protestant Reformed Church", shall be deleted.

( d ) The following clause shall be substituted for clause 6—

"(6) The members of the Society shall consist of Governors — whether Annual Governors or Life Governors."

( e ) In clause 7 the words "and ordinary Members" shall be deleted.

( f ) The following clause shall be substituted for clause 8—

"(8) All persons who on the 31st day of December, 1978 are Life Members of the Society shall as and from that date be Life Governors and have all the rights and duties and privileges prescribed for Life Governors. No person not being a Governor shall be eligible to be appointed President or Vice-President of the Society."

( g ) Clauses 9, 10 and 20 shall be deleted.

( h ) In clause 11 the words "subject to the Fundamental Principle of the Society," "Members and" and "as Life Members or" shall be deleted.

( i ) In clause 12 the word "Governors" shall be substituted for the words "Ordinary Members".

( j ) In clause 15 the word "Governors" shall be substituted for the words "ordinary Members thereof".

( k ) In clause 17 the words "and ordinary Members of the Society" and "or ordinary Member of the Society" shall be deleted.

( l ) In clause 19 the word "Honorary" shall be deleted where it occurs before "Members",

( m ) In clause 21 the words "consider most appropriate to the needs" shall be substituted for the words "judge most eligible and conducive to the health".

( n ) In clause 23 the words "Secretary/Managers" shall be substituted for the word "Registrars" and the words "and as the income from time to time of the Society may suffice to pay" shall be deleted.

( o ) In clause 27 the words "Board of Management" shall be substituted for the words "Society in General Meeting" and the word "Ireland" shall be substituted for the words "that part of Our said United Kingdom of Great Britain and Ireland called Ireland".

( p ) In clause 29 the words "in such manner as the Board may in their absolute discretion from time to time determine; and the Board may from time to time vary and transpose the said investments into or for others of any nature hereby authorised" shall be substituted for the words from and including "in the Government Funds" to the end of that clause.

( q ) In clause 30 the words "and that such Lease be made to take effect in possession, or within six months from the execution hereof, and that the tenant do execute a counterpart thereof" shall be deleted.

( r ) In clause 32 the words "subject to the sanction of Us, Our Heirs, or Successors, and upon such terms as we or they may consider fit" and the word "Our" where it appears before the word "Charter" shall be deleted.

( s ) In clause 33 the words "granted by Us, Our Heirs, or Successors," shall be deleted.

A draft of this Order was pursuant to section 76 (2) of the Health Act, 1970 laid before each House of the Oireachtas and was approved by the Resolution of Dáil Éireann on 16th October, 1980 and by Resolution of Seanad Éireann on 22nd October, 1980.

EXPLANATORY NOTE.

The effect of this Order is to amend the charter of the Adelaide Hospital by removing certain provisions which restrict to members of the Protestant Reformed Church the right to hold appointments in the hospital, to vote or take part in proceedings of the hospital, or, except in cases of emergency, to be admitted as an in-patient or to communicate religious instruction in the hospital. It also deletes provisions relating to "members" of the hospital and provides that persons who are life members on the 31st December, 1978 should become Governors of the hospital. It also deletes certain references to the United Kingdom of Great Britain and Ireland and substitutes references to Ireland.
