S.I. No. 276 of 1980.

ARTS ACT, 1951 (ADDITIONAL FUNCTION) (AMENDMENT) ORDER, 1980.

The Government, in exercise of the power conferred on them by section 3 (4) of the Arts Act, 1951 (No. 9 of 1951), hereby order as follows:

1. (1) This Order may be cited as the Arts Act, 1951 (Additional Function) (Amendment) Order, 1980.

(2) The Arts Act, 1951 (Additional Function) Order, 1966 ( S.I. No. 155 of 1966 ), and this Order may be cited together as the Arts Act, 1951 (Additional Function) Orders, 1966 and 1980.

2. The Schedule to the Arts Act, 1951 (Additional Function) Order, 1966, is hereby amended by—

( a ) the substitution of the following for Paragraph 1:

"1. An Chomhairle Ealaíon (hereinafter referred to as the Council) may establish and administer a fund from which annuities or grants may be paid in such manner as the Council think fit to creative workers in the arts of painting, sculpture, architecture, music, drama, literature, design and in the fine and applied arts generally or to their dependants, in recognition of outstanding services in one or more of these arts in Ireland."

( b ) the substitution of the following for Paragraph 2—

"2. Annuities or grants from the fund shall be payable only to—

( a ) Creative artists who are advanced in years or who by reason of ill-health are unable any longer to fend properly for themselves or to provide for their dependants.

( b ) Persons who are unable to fend for themselves and who are the widow or widower, a surviving son or daughter, a surviving brother or sister or a surviving dependent of a creative artist and for whom such artist had been unable properly to provide. ".

( c ) the insertion in Paragraph 3 of the words "or grants" immediately after the word "Annuities ..." and before the words "... from the fund ....."

( d ) the substitution of the following for Paragraph 4 —

"4. The Council shall invest any moneys received for the purposes of the fund —

( a ) in or upon such securities as may for the time being be authorised by law for the investment of trust funds;

( b ) in or upon such other securities as are for the time being for the purposes of this Order sanctioned by the Minister for Finance and to such extent as is for the time being so sanctioned." and

( e ) the substitution of the following for Paragraph 6—

"6. The Council may utilise for the purpose of the fund part of the grant paid to the Council annually out of moneys provided by the Oireachtas; provided that the amount utilised under this paragraph shall not exceed in any particular year an amount approved of by the Taoiseach in relation to that year.".

EXPLANATORY NOTE

This Order enables An Chomhairle Ealaíon to utilise part of the grant paid to it annually out of moneys provided by the Oireachtas for the purposes of Ciste Cholmcille, to increase the ranges of investment options for the fund so as to include securities authorized in respect of trust funds, and to enable annuities or grants to be paid to widows or widowers or other dependants of creative artists where the artist has not been able to provide for them.
