LOCAL GOVERNMENT (PLANNING AND DEVELOPMENT) (AMENDMENT) REGULATIONS, 1980.

The Minister for the Environment in exercise of the powers conferred on him by sections 10 and 89 of the Local Government (Planning and Development) Act, 1963 , (No. 28 of 1963), hereby makes the following Regulations:—

1. (1) These Regulations may be cited as the Local Government (Planning and Development) (Amendment) Regulations, 1980.

(2) These Regulations and the Local Government (Planning and Development) Regulations, 1977 ( S.I. No. 65 of 1977 ) may be cited together as the Local Government (Planning and Development) Regulations 1977 to 1980.

2. Article 57(1) of the Local Government (Planning and Development) Regulations, 1977, is hereby amended by the substitution for the words "to the Central Motor Tax Account" of the words "to the county fund in the case of a council of a county and to the municipal fund in the case of a corporation of a county or other borough or the council of an urban district".

EXPLANATORY NOTE.

Article 57(1) of the Local Government (Planning and Development) Regulations, 1977, provided that licence fees collected by planning authorities in respect of petrol or oil pumps should be paid to the Central Motor Tax Account. These amending Regulations provide that such fees shall, like all other planning licence fees, be paid into the County Fund or Municipal Fund as appropriate.
