SOCIAL WELFARE (CONTRIBUTIONS) (TRANSITIONAL) (AMENDMENT) REGULATIONS, 1980.

The Minister for Social Welfare, in exercise of the powers conferred on him by virtue of section 3 of the Social Welfare Act, 1952 (No. 11 of 1952) and by section 20 of the Social Welfare (Amendment) Act 1978 (No. 25 of 1978), hereby makes the following Regulations:—

1. These Regulations may be cited as the Social Welfare (Contributions) (Transitional) (Amendment) Regulations, 1980.

2. These Regulations and the Social Welfare (Contributions) (Transitional) Regulations, 1979, ( S.I. No. 86 of 1979 ) (hereinafter called the Principal Regulations) shall be construed as one and may be cited together as the Social Welfare (Contributions) (Transitional) Regulations, 1979 and 1980.

3. Where the provisions of articles 8, 9 or 10 of the Principal Regulations would operate to disentitle an insured person or to reduce or otherwise adversely affect entitlement to any benefit or pension referred to in those articles, the claim to the benefit or pension in question may be determined in accordance with the provisions of the Social Welfare Acts 1952 to 1978 and Regulations under those Acts effective before the 6th day of April 1979.

EXPLANATORY NOTE

The Regulations provide for contribution years in operation under the provisions of the Social Welfare Acts and Regulations effective before the 6th day of April 1979 to be used in the determination of the contribution conditions for social welfare benefits and pensions during a transitional period, if it would be to the advantage of an insured person.
