RESTRICTIVE PRACTICES (MOTOR SPIRIT) ORDER, 1980.

I, DESMOND O'MALLEY, Minister for Industry, Commerce and Tourism, in exercise of the powers conferred on me by Section 8 (2) of the Restrictive Practices Act, 1972 (No. of 1972), and of the Industry, Commerce and Tourism (Alteration of Name of Department and Title of Minister) Order, 1980 ( S.I. No. 10 of 1980 ), hereby order as follows:

1. This Order may be cited as the Restrictive Practices (Motor Spirit) Order, 1980.

2. This Order and the Restrictive Practices (Motor Spirit and Motor Vehicle Lubricating Oil) Orders, 1961 to 1979, may be cited together as the Restrictive Practices (Motor Spirit and Motor Vehicle Lubricating Oil) Orders, 1961 to 1980.

3. Article 3 of the Restrictive Trade Practices (Motor Spirit) Order, 1972 ( S.I. No. 150 of 1972 ), is hereby amended by the substitution of "eight years and six months" for "eight years" (inserted by the Restrictive Practices (Motor Spirit Order, 1979 ( S.I. No. 202 of 1979 )) in paragraph (1), and the said paragraph (1), as so amended, is set out in the Table to this Article.

TABLE

(1) Subject to the provisions of this Article, during a period of eight years and six months from the commencement of this Order, a person shall not operate as a company station a motor spirit station that was not operated as a company station immediately before such commencement.

EXPLANATORY NOTE

The effect of this Order is to extend for a period of six months the provision in the Restrictive Trade Practices (Motor Spirit) Order, 1972, as amended by the Restrictive Practices (Motor Spirit) Order, 1979, which prohibits petrol companies from operating additional retail outlets.
