RACING BOARD AND RACECOURSES (TRANSFER OF DEPARTMENTAL ADMINISTRATION AND MINISTERIAL FUNCTIONS) ORDER, 1980.

THE GOVERNMENT, in exercise of the powers conferred on them by Section 6 (1) of the Ministers and Secretaries (Amendment) Act, 1939 (No. 36 of 1939) hereby order as follows:

1. This Order may be cited as the Racing Board and Racecourses (Transfer of Departmental Administration and Ministerial Functions) Order, 1980.

2. In this Order—

"the Act of 1945" means the Racing Board and Racecourses Act, 1945 (No. 16 of 1945);

"functions" includes powers and duties.

3. The administration and business in connection with the exercise, performance or execution of any function transferred by Article 4 of this Order are hereby transferred to the Department of Agriculture.

4. Subject to Article 5 of this Order, the functions vested in the Minister for Finance by or under the Racing Board and Racecourses Acts, 1945 and 1975, are hereby transferred to the Minister for Agriculture.

5. (1) On and from the commencement of this Order, the Act of 1945 is hereby adapted as follows:

( a ) the reference to the Minister for Finance in section 2 shall be construed as a reference to the Minister for Agriculture,

( b ) section 5 (2) shall be construed and have effect as if "acting after consultation with the Minister for Finance" were inserted after "the Minister",

( c ) section 6 shall be construed and have effect as if,

(i) "after consultation with the Minister for Finance" were inserted before "appoint" both in subsection (3) and in subsection (5), and

(ii) subsection (9) were deleted,

( d ) section 17 shall be construed and have effect as if "given with the concurrence of the Minister for Finance" were inserted after "the Minister",

( e ) section 19 (2) shall be construed and have effect as if ", with the concurrence of the Minister for Finance," were inserted before "may" in paragraph (a).

(2) In section 20 of the Act of 1945, as adapted by paragraph (1) of this Article, the reference to the Minister shall be construed as including a reference to the Minister for Finance.

EXPLANATORY NOTE

This Order provides for the transfer of certain Ministerial functions in relation to the Racing Board from the Minister for Finance to the Minister for Agriculture. The general result is that, whereas the Minister for Finance previously exercised a particular function in consultation with the Minister for Agriculture, that function will, in future, be exercised by the latter in consultation with, or with the concurrence of, the Minister for Finance. The functions of the Minister for the Public Service remain unchanged.
