SUGAR MANUFACTURE (TRANSFER OF DEPARTMENTAL ADMINISTRATION AND MINISTERIAL FUNCTIONS) ORDER, 1980.

The Government, in exercise of the powers conferred on them by section 6 (1) of the Ministers and Secretaries (Amendment) Act, 1939 (No. 36 of 1939), hereby order as follows:

1. This Order may be cited as the Sugar Manufacture (Transfer of Departmental Administration and Ministerial Functions) Order, 1980.

2. In this Order—

"the Act of 1973" means the Sugar Manufacture (Amendment) Act, 1973 (No. 6 of 1973);

"functions" includes powers and duties.

3. (1) The administration and business in connection with the exercise, performance or execution of any functions transferred by Article 5 of this Order are hereby transferred to the Department of Agriculture.

(2) References to the Department of Finance contained in any Act or instrument made thereunder and relating to any administration and business transferred by paragraph (1) of this Article shall, on and after the commencement of this Order, be construed as references to the Department of Agriculture.

4. (1) The administration and business in connection with the exercise, performance or execution of any functions transferred by Article 6 of this Order are hereby transferred to the Department of Finance.

(2) References to the Department of Agriculture contained in any Act or instrument made thereunder and relating to any administration and business transferred by paragraph (1) of this Article shall, on and after the commencement of this Order, be construed as references to the Department of Finance.

5. (1) The functions vested in the Minister for Finance—

( a ) by or under sections 6, 13, 14 and 15 (as amended by the Act of 1973) of, and paragraph 1 and subparagraphs (b) and (d) of paragraph 3 (inserted by the Act of 1973) of the Schedule to, the Sugar Manufacture Act, 1933 (No. 31 of 1933), and

( b ) by or under the Worker Participation (State Enterprises) Act, 1977 (No. 6 of 1977), by virtue of section 2 of that Act,

are hereby transferred to the Minister for Agriculture.

(2) References to the Minister for Finance contained in any Act or instrument made thereunder and relating to any functions transferred by this Article shall, on and after the commencement of this Order, be construed as references to the Minister for Agriculture.

6. (1) The functions vested in the Minister for Agriculture by or under sections 6, 13 and 14 of, and paragraph 1 of the Schedule to, the Sugar Manufacture Act, 1933 , are hereby transferred to the Minister for Finance.

(2) References to the Minister for Agriculture contained in any Act or instrument made thereunder and relating to any functions transferred by this Article shall, on and after the commencement of this Order, be construed as references to the Minister for Finance.

7. The Sugar Manufacture Act, 1933 , is hereby adapted—

( a ) in section 6, by the substitution of "with the consent of the Minister for Finance and after consultation with" for "after consultation with the Minister for Agriculture and",

( b ) in the Schedule—

(i) in paragraph (2) (e), by the insertion after "Minister" of "given after consultation with the Minister for Agriculture", and

(ii) in paragraph 3 (inserted by the Act of 1973) by—

(I) the insertion in sub-paragraph (b) after "Minister" of "after consultation with the Minister for Finance", and

(II) the insertion in sub-paragraph (d) after "Minister" of "given with the consent of the Minister for Finance".

EXPLANATORY NOTE.

This Order provides for the transfer of certain Ministerial functions in relation to Comhlucht Siúicre Éireann Teoranta from the Minister for Finance to the Minister for Agriculture. The general result is that, whereas the Minister for Finance previously exercised a particular function in consultation with the Minister for Agriculture, that function will, in future, be exercised by the latter in consultation with, or with the consent of, the Minister for Finance. The functions of the Minister for Industry, Commerce and Tourism remain unchanged.
