LABOUR COURT (MEMBERS) SUPERANNUATION SCHEME (AMENDMENT) SCHEME, 1979.

I, GENE FITZGERALD, Minister for Labour, in exercise of the powers conferred on me by section 5 (2) of the Industrial Relations Act, 1969 (No. 14 of 1969), and with the concurrence of the Minister of State at the Department of the Public Service in exercise of the power conferred on him by the Public Service (Transfer of Departmental Administration and Ministerial Functions) Order, 1973 ( S.I. No. 294 of 1973 ), and by the Public Service (Delegation of Ministerial Functions) Order, 1978 ( S.I. No. 117 of 1978 ), hereby make the following scheme.

1. This Scheme may be cited as the Labour Court (Members) Superannuatation Scheme (Amendment) Scheme, 1979.

2. Article 4 of the Labour Court (Members) Superannuation Scheme, 1971, is hereby amended by the insertion after paragraph (2) of the following paragraph:

"(3) Notwithstanding the provisions of this scheme, any person referred to in paragraph (1) of this Article who, immediately prior to being appointed a wholetime member of the Labour Court was serving in an established position in the Civil Service (within the meaning of the Civil Service Regulation Act, 1956 (No. 46 of 1956)), shall, in lieu of any benefits which might otherwise be payable to, or in respect of, him under this Scheme, have the terms of the Superannuation Acts, 1834 to 1963, applied to him on the cessation of his membership of the Labour Court as if he were an established civil servant on that date, and, for the purposes of the application of the said Superannuation Acts to such a person, his service as a wholetime member of the Labour Court shall be deemed to be service as a civil servant ".
