EUROPEAN COMMUNITIES (MISCELLANEOUS TEXTILE PIECE GOODS) REGULATIONS, 1979.

I, DESMOND O'MALLEY, Minister for Industry, Commerce and Energy, in exercise of the powers conferred on me by section 3 of the European Communities Act, 1972 (No. 27 of 1972), and for the purpose of giving effect to Council Regulation No. 925/791 of the 8th day of May, 1979, Council Decision No. 210/752 of the 27th day of March, 1975 (as amended), and Commission Regulation No. 3020/773 of the 30th day of December, 1977, which was confirmed by Council Regulation No. 255/784 of the 7th day of February, 1978 hereby make the following regulations:

1. These Regulations may be cited as the European Communities (Miscellaneous Textile Piece Goods) Regulations, 1979, and shall come into operation on the 28th day of July, 1979.

2. In these Regulations "the Order of 1964" means the Control of Imports (Quota No. 52) (Miscellaneous Textile Piece Goods) Order, 1964 ( S.I. No. 298 of 1964 ).

3. The prohibition effected in respect of the importation of certain goods by the Order of 1964 (as amended) shall not extend or apply to goods which are—

( a ) specified at a tariff code number in column (1) of the First Schedule to these Regulations,

( b ) of a description specified in column (2) of that Schedule opposite the mention in column (1) of a tariff code number,

( c ) shown to the satisfaction of the Revenue Commissioners to have been manufactured in Albania, Bulgaria, the People's Republic of China, Czechoslovakia, East Germany, Mongolia, North Korea, Union of Soviet Socialist Republics or Vietnam.

4. The prohibition effected in respect of the importation of certain goods by the Order of 1964 (as amended) shall not apply or extend to goods which are specified at tariff code number ex 59.12—000 and are of the following description, that is to say—

"Textile fabrics otherwise impregnated or coated; painted canvas being theatrical scenery, studio backcloths or the like:

—textile fabrics, printed, painted or embossed (other than knitted or crocheted goods);

—linen tape, of a width not exceeding 2 inches, having two selvedges;

—textile fabrics, knitted or crocheted;

—other, woven"

and

which are shown to the satisfaction of the Revenue Commissioners to have been manufactured in Albania, Bulgaria, the People's Republic of China, Czechoslovakia, East Germany, Mongolia, Romania, Hungary, North Korea, Poland, Union of Soviet Socialist Republics or Vietnam.

5. The Order of 1964 shall have effect as if the First Schedule thereto were amended—

( a ) by the addition of goods which are—

(i) specified at a tariff code number in column (1) of the Second Schedule to these Regulations,

(ii) of a description specified in column (2) of that Schedule opposite the mention in column (1) of a tariff code number,

(iii) shown to the satisfaction of the Revenue Commissioners to have been manufactured in Albania, Bulgaria, the People's Republic of China, Czechoslovakia, East Germany, Mongolia, North Korea, Union of Soviet Socialist Republics or Vietnam, and

( b ) by the substitution in the second column of that Schedule, as amended, opposite "woven fabrics of silk, waste silk or noil silk" in the first column for "Goods specified at tariff heading number 50.09 but excluding those specified at tariff code numbers 50.09—048, 50.09—150, 50.09—182, 50.09—238 and 50.09—321" of "Goods specified at tariff heading number 50.09 but excluding those specified at 50.09—ex—010, ex—200, ex—310, ex—390, ex—410, ex—420, ex—440, ex—450, ex—470, ex—480, —800".

6. The prohibition effected in respect of the importation of certain goods by the Order of 1964 (as amended) shall not extend or apply to goods which are of a description specified in that Order and which are shown to the satisfaction of the Revenue Commissioners to have been manufactured in Taiwan.

EXPLANATORY NOTE.

The effect of these Regulations is to amend the Control of Imports (Quota No. 52) (Miscellaneous Textile Piece Goods) Order, 1964 with effect from 28th July, 1979 by:—

(i) making alterations in the range of certain textile goods coming within the scope of the Order originating in Albania, Bulgaria, the People's Republic of China, Czechoslovakia, East Germany, Romania, Hungary, Mongolia, North Korea, Poland, U.S.S.R. and Vietnam.

(ii) removing from the scope of the Order in respect of Taiwan all goods to which the Order now applies.
