EUROPEAN COMMUNITIES (MISCELLANEOUS TEXTILES) REGULATIONS, 1979.

I, DESMOND O'MALLEY, Minister for Industry, Commerce and Energy, in exercise of the powers conferred on me by section 3 of the European Communities Act, 1972 (No. 27 of 1972), and for the purpose of giving effect to Council Regulation No. 925/791 of the 8th day of May, 1979, Council Decision No. 210/752 of the 27th day of March, 1975 (as amended), Commission Regulation No. 3020/773 of the 30th day of December, 1977 which was confirmed by Council Regulation No. 255/784 of the 7th day of February, 1978 and Council Regulation No. 2532/785 of the 16th day of October, 1978 hereby make the following regulations:

1. These Regulations may be cited as the European Communities (Miscellaneous Textiles) Regulations, 1979 and shall come into operation on the 28th day of July, 1979.

2. In these Regulations "the Order of 1964" means the Control of Imports (Quota No. 51) (Miscellaneous Textiles) Order, 1964 ( S.I. No. 297 of 1964 ).

3. The prohibition effected in respect of the importation of certain goods by the Order of 1964 (as amended) shall not extend or apply to goods which are—

( a ) specified at a tariff code number in column (1) of the First Schedule to these Regulations,

( b ) of a description specified in column (2) of that Schedule opposite the mention in column (1) of a tariff code number,

( c ) shown to the satisfaction of the Revenue Commissioners to have been manufactured in Albania, Bulgaria, the People's Republic of China, Czechoslovakia, East Germany, Mongolia, North Korea, Union of Soviet Socialist Republics or Vietnam.

4. Subject to Article 5 of these Regulations, the Order of 1964 shall have effect as if the First Schedule thereto were amended by the addition of the goods which are—

( a ) specified at a tariff code number in column (1) of the Second Schedule to these Regulations,

( b ) of a description specified in column (2) of that Schedule opposite the mention in column (1) of a tariff code number,

( c ) shown to the satisfaction of the Revenue Commissioners to have been manufactured in Albania, Bulgaria, the People's Republic of China, Czechoslovakia, East Germany, Mongolia, North Korea, Union of Soviet Socialist Republics or Vietnam.

5. The prohibition effected by Article 4 of these Regulations shall not extend or apply to goods which are shown to the satisfaction of the Revenue Commissioners to have been manufactured in the People's Republic of China and are of the following description

( a ) Crests, badges and motifs; belts, dress shields, shoulder pads and other such pads which are covered or laminated with artificial plastic material which goods are classified at tariff code number 61.11—000, or

( b ) Blankets, which are classified at tariff code numbers 62.01—100, —200, —810, —850, —930 and —950.

6. The prohibition effected in respect of the importation of certain goods by the Order of 1964 (as amended) shall not extend or apply to goods which are shown to the satisfaction of the Revenue Commissioners to have been manufactured in the People's Republic of China and are of the following description, that is to say—

( a ) certain made-up accessories for articles of apparel which are classified at tariff code number ex 61.11—000, and

( b ) travelling rugs which are classified at tariff code numbers 62.01—ex—100, ex—200, ex—810, ex—850, ex—930 and ex—950.

7. The prohibition effected in respect of the importation of certain goods by the Order of 1964 (as amended) shall not extend or apply to goods of a description specified in that Order other than sacks and bags of a kind used for the packing of goods, other than of wool, cotton and man-made fibres, which are classified at tariff code numbers 62.03—110,— -130,—150, —170 and —910 and which are shown to the satisfaction of the Revenue Commissioners to have been manufactured in Taiwan.

EXPLANATORY NOTE.

The effect of these Regulations is to amend the Control of Imports (Quota No. 51) (Miscellaneous Textiles) Order, 1964 with effect from 28th July, 1979 by:—

(i) adding to the scope of the Order certain made-up textile goods originating in Albania, Bulgaria, the People's Republic of China, Czechoslovakia, East Germany, Mongolia, North Korea, U.S.S.R. and Vietnam;

(ii) removing from the scope of the Order

( a ) certain yarns and certain sacks and bags,

( b ) certain made-up accessories and blankets in respect of China, and

( c ) all goods in respect of Taiwan except certain sacks and bags.
