S.I. No. 229/1979 - Referendum (Local Returning Officers' Charges) (No. 2) Regulations, 1979.


I, SEOIRSE Ó COLLA, Minister for Finance, in exercise of the powers conferred on me by section 12 (5) of the Referendum Act, 1942 (No. 8 of 1942) (as extended by section 64 (4) of the Electoral Act, 1963 (No. 19 of 1963)), and section 91 (5) of the said Electoral Act, 1963 , hereby make the following regulations:

1. These Regulations may be cited as the Referendum (Local Returning Officers' Charges) (No. 2) Regulations, 1979.

2. In these Regulations—

"constituency", except in the expression "Dáil constituency", means a constituency for the purpose of taking the poll at a referendum referred to in section 1 of the Referendum (Amendment) Act, 1979 ;

"Dáil constituency" means a constituency specified in the Schedule to the Electoral (Amendment) Act, 1974 (No. 7 of 1974);

"the Principal Regulations" means the Referendum (Local Returning Officers' Charges) Regulations, 1979 ( S.I. No. 209 of 1979 ).

3. These Regulations apply to any constituency which contains the whole or part of any four or more Dáil constituencies.

4. In addition to being entitled to charges and expenses calculated in accordance with the Principal Regulations, the local returning officer for a constituency to which these Regulations apply shall be entitled to such further expenses in respect of the counting of the votes and the assistance referred to in paragraph (B) (3) (a) of the Schedule to the Principal Regulations calculated in accordance with such scale as shall be determined for the purposes of these Regulations by the Minister for Finance.

EXPLANATORY NOTE.

These regulations extend, to a limited extent, the Referendum (Local Returning Officers' Charges) Regulations, 1979 ( S.I. No. 209 of 1979 ) which set out the scale of maximum charges for local returning officers in respect of two referenda held on the same day.
