ROAD VEHICLES (REGISTRATION AND LICENSING) (AMENDMENT) (No. 3) REGULATIONS, 1977.

The Minister for the Environment in exercise of the powers conferred on him by sections 5, 6 and 12 of the Roads Act, 1920 and sections 1 and 3 of the Finance (Excise Duties) (Vehicles) Act, 1952 (No. 24 of 1952) hereby makes the following Regulations:—

1. (1) These Regulations may be cited as the Road Vehicles (Registration and Licensing) (Amendment) (No. 3) Regulations, 1977.

(2) These Regulations and the Road Vehicles (Registration and Licensing) Regulations, 1958 to 1977, shall be construed together.

(3) The collective citation the Road Vehicles (Registration and Licensing) Regulations, 1958 to 1977 shall include these Regulations.

(4) These Regulations shall come into operation on the 1st day of January, 1978.

2. In these Regulations—

"the Principal Regulations" means the Road Vehicles (Registration and Licensing) Regulations, 1958 ( S.I. No. 13 of 1958 ).

3. Sub-article (5) of article 1 of the Principal Regulations is hereby amended by the addition of the following definition—

"'post office vehicle' means a vehicle owned by the Department of Posts and Telegraphs".

4. Article 18 of the Principal Regulations as amended by article 5 of the Road Vehicles (Registration and Licensing) (Amendment) Regulations, 1974 ( S.I. No. 340 of 1974 ) is hereby amended—

( a ) by the insertion in clause (c) of "or a post office vehicle" after "military vehicle" and

( b ) by the insertion in clause (cc) of "and in the case of a post office vehicle — the Department of Posts and Telegraphs" after "Department of Defence".

5. Sub-article (3) of article 19 of the Principal Regulations as amended by article 6 of the Road Vehicles (Registration and Licensing) (Amendment) Regulations, 1974 ( S.I. No. 340 of 1974 ) is hereby amended by the insertion of "or in the case of a post office vehicle on receipt of an application from a duly authorised officer of the Department of Posts and Telegraphs" after "Department of Defence".

6. Article 22 of the Principal Regulations as amended by article 7 of the Road Vehicles (Registration and Licensing) (Amendment) Regulations, 1974 ( S.I. No. 340 of 1974 ) is hereby amended—

( a ) by the insertion in paragraph (a) of sub-article (4) of "or a post office vehicle" after "military vehicle" and

( b ) by the insertion in paragraph (b) of sub-article (4) of "or a post office vehicle ceases to be used as a post office vehicle" after "as a military vehicle".

EXPLANATORY NOTE.

These Regulations amend the Road Vehicles (Registration and Licensing) Regulations, 1958 ( S.I. No. 13 of 1958 ) so as to provide that post office vehicles will be exempt from the requirements of Part 1 of the Regulations in so far as the licensing of such vehicles is concerned.
