ROAD VEHICLES (REGISTRATION AND LICENSING) (AMENDMENT) (NO. 2) REGULATIONS, 1977.

The Minister for Local Government in exercise of the powers conferred on him by sections 6 and 12 of the Roads Act, 1920 and section 1 of the Finance (Excise Duties) (Vehicles) Act, 1952 (No. 24 of 1952) hereby makes the following Regulations:—

1. (1) These Regulations may be cited as the Road Vehicles (Registration and Licensing) (Amendment) (No. 2) Regulations, 1977.

(2) These Regulations and the Road Vehicles (Registration and Licensing) Regulations, 1958 to 1977, shall be construed together.

(3) The collective citation the Road Vehicles (Registration and Licensing) Regulations, 1958 to 1977, shall include these Regulations.

2. The Road Vehicles (Registration and Licensing) Regulations, 1958 ( S.I. No. 13 of 1958 ) as amended by the Road Vehicles (Registration and Licensing) (Amendment) Regulations, 1976 ( S.I. No. 38 of 1976 ) is hereby amended by the substitution for article 26 of the following article—

"26 (1) For the purposes of section 1 of the Act of 1952, for periods beginning on or after the first day of March, 1976 the periods of a year less than a year for which a licence may be taken out in respect of a vehicle (not being a tramcar or a vehicle on which a duty of five pounds or less is chargeable) shall, subject to the modifications specified in sub-article (2) of this article, be such as are hereinafter specified and the duties payable in respect of licences for such periods shall be at the rates hereinafter specified:—

( a ) A licence may be taken out for a period of three months ending on the last day of any month on payment of eleven fortieths of the full annual rate of duty (any fraction of fifty pence in the amount so calculated being treated as fifty pence if it is not less than twenty-five pence and otherwise being disregarded);

( b ) A licence may be taken out for a period of six months ending on the last day of any month on payment of whichever of the following is the lesser, that is to say

(i) eleven twentieths of the full annual rate of duty (any fraction of fifty pence in the amount so calculated being treated as fifty pence if it is not less than twenty-five pence and otherwise being disregarded),

(ii) twice the rate appropriate to a period of three months calculated in accordance with paragraph (a) of this article."

(2) For the purpose of section 1 of the Act of 1952, notwithstanding the provisions of article (1) of this article, a licence may be taken out in respect of—

(i) a vehicle on which duty is charged and levied at the rates specified in paragraph 1 of Part I of the Schedule to the Act of 1952 (not being a vehicle on which a duty of five pounds or less is chargeable), or

(ii) a vehicle on which duty is charged and levied at the rates specified in sub-paragraph (d) of paragraph 6 of Part I of the Schedule to the said Act

for such periods as are hereinafter specified and the duties payable in respect of licences for such periods shall be at the rates hereinafter specified:—

( a ) A licence may be taken out for a period of two months ending on the last day of July, 1977 on payment of two thirds the rate appropriate to a period of three months (any fraction of fifty pence in the amount so calculated being treated as fifty pence if it is not less than twenty-five pence and otherwise being disregarded);

( b ) A licence may be taken out for a period of one month ending on the last day of July, 1977 on payment of one third the rate appropriate to a period of three months (any fraction of fifty pence in the amount so calculated being treated as fifty pence if it is not less than twenty-five pence and otherwise being disregarded)."

EXPLANATORY NOTE.

These Regulations amend the Road Vehicles (Registration and Licensing) Regulations, 1958 ( S.I. No. 13 of 1958 ) and the Road Vehicles (Registration and Licensing) (Amendment) Regulations, 1976 ( S.I. No. 38 of 1976 ) so as to provide that licences under section 1 of the Finance (Excise Duties) (Vehicles) Act, 1952 may be taken out for periods of one month or two months expiring on the last day of July, 1977 in respect of certain vehicles taxable under paragraphs 1 and 6 (d) of Part I of the Schedule to the Finance (Excise Duties) (Vehicles) Act, 1952 (principally "private" cars and cycles exceeding 150 c.c.).
